RESOLUTION ESTABLISHING A SMOKING FOLICY COUNTY FACILITIES
WHEREAS, the promotion of public health is a major mission of
the County; and
WHEREAS, numerous studies have found that tobacco smoke is a
major contributor to indoor air pollution; and
WHEREAS, reliable studies have shown that breathing of sidestream
or second hand smoke is a significant health hazard for certain
population groups, including elderly people, individuals with
cardiovascular disease, and individuals with impaired respiratory
function, including asthmatics and those with obstructive airway
disease; and
WHEREAS, the individuals who develop or have respiratory disorders
as a result of sidestream or second hand smoke have been found as
employees to have a compensable worker illness or injury through the
Workers Compensation system and are considered handicapped individuals
by the State of California, Department of Fair Employment and Housing,
who should be provided reasonable accomodation in not being exposed to
tobacco smoke in the workplace,
NOW, THEREFORE BE IT RESOLVED by this Board that there shall be no
smoking in all County facilities where common heating and air
conditioning systems permit sidestream or second hand smoke to be
breathed by non-smokers.* Each department head is responsible for the
enforcement of this policy within the work areas they control.
Any dispute as to the enforcement shall be resolved by this
Health Officer, who shall have final authority to enforce this policy
as now and may in the future be provided.
PASSED AND ADOPTED by the Board of Supervisors on this 18th day
of June , 1991, by the following vote:
AYES: Supervisors Alclnturf, McLaughlin, Fulton and Chair Dolan
