' ~ • .,+ . , ,.• • .--- h'esolution 2Vo. 91-g1 5 RESOLUTION ABANDONING A PUBLIC RIGHT-OF-WAY (ALLEY RIGHT-OF-WAY ADJOINING AP 043-230-009) WHEREAS, this matter came on regularly for hearing before the Board of Supervisors of the County of Butte, State of California, on ~~~~ p, 1991, in the Board Chambers, Butte County Administration Building, Oroville, California; and WHEREAS, it appears to said Board that notice of the time and place of the hearing on the petition for the abandonment of the right--of-way in question was duly and regularly given as required by law; and WHEREAS, testimony and evidence, both oral and documentary, having been produced at said hearing, from which said Board now finds that the hereinafter described right-of-way is unnecessary for present or prospective public use. NOW, THEREFORE, IT IS HEREBY ORDERED as follows: 1. That the public right-of-way situated in the County of Butte, State of California, as hereinafter more particularly described, is hereby abandoned pursuant to Chapter 3 of Part 3 of Division 9 of the California Streets and Highways Code {commencing with Section 8320). 2. That said public right-of-way so abandoned is located in the unincorporated area of the County of Butte, State of California, is identified as an alley right-of-way adjoining AP 043-230-009, and more particularly described as follows: See Legal description on Exhibit A attached hereto. 3. That a map showing the right-of-way hereby abandoned is on file in the Office of Butte County Department of Public Works, 7 County Center Drive, Oroville, California 95965. ' 4. That the erk of the Board shall ca•. ~~ a certified copy of this Resolution, with the seal of the Board of Supervisors of the County of Butte, State of California, to be recorded in the office of the Recorder of the County of Butte, State of California. RANDOLPFI Chief Administrative Officer and Clerk of the Board ~~-~~~ ~~-ice (abanrow2.res) ~TT rrArr AT T ~Y A~I~NM~r RIGEiT OF WAY AP 43-23-09 Being that certain 12-foot alley lying within Section 27, T22N, R1E, M.D.B. & M. as shown on the map of Pioneer Block, recorded in Book 1, Maps of Record, at Page 56, County of Butte, State of California, more particularly described as follows: Being that certain 12-foot alley lying Southeasterly of and contiguous to the Southeasterly lot line of Lot One of said Pioneer Block, extending along the entire length of said Southeastefly lot line of said Lot One, from the North- easterly right of way line of State Highway 32 {Nord Avenue} to the South- easterly extension of the Southwesterly right of way line of the 16-foot wide alley running along the Northeasterly side of said Pioneer Block. "R~vu~g, however, to Pacific Gas and Electric Company the right from time to time to install, maintain., repair, operate, replace, remove and renew lines, pipes, wires, poles and other structures, equipment and fixtures, both above ground and underground for the operation of said facilities in the southwesterly 1Q-feet by 12-feet of the alley adjacent to Nord Avenue {State Highway 32) as a public utility easement." Said map showing the alley to be abandoned is on file in the Office of Butte County Department of Public Works, #7 County Center Drive, Oroville, CA 95965.
