RESOLUTION ACCEPTING GRANT DEED
BUTTS CREEK CANYON FIRE STATION
WHEREAS, Erika Alm, Trustee of the Alm Trust, has
executed a grant deed to the County of Butte contributing a 0.79
j acre parcel of land for the placement of a fire station in Butte
J
v Creek Canyon; and
~ WHEREAS, said grant deed is attached hereto as attachment
1; and
`~ WHEREAS, it is the desire of the Butte County Board of
-.~ Supervisors to accept the grant deed conveyance under the
~ conditions present.
rj NOW, THEREFORE, be it resolved by the Butte County Board
of Supervisors that it hereby accepts the property as identified

in the grant deed attached hereto as attachment 1 dated May 14,
1991.
BE IT FURTHER RESOLVED, that the Clerk of the Board of
~ Supervisors is instructed to record this resolution and the grant
(~~, deed in the Office of the Butte County Recorder.

in Exhibit "A" attached hereto, together with a non-exclusive easement for
t roadway purposes of ingress and egress to and from the property described in
I~ Exhibit "A", limited to the use of the property described in Exhibit "A" as
a fire station, over the property of Grantor which is adjacent to and south-
easterly of the southeast property line of the property described in Exhibit
~ "A", and, specifically, a strip of land sixty feet in width parallel to the
~ southeast boundary line of the property described in Exhibit "A", the north
end of which strip is The Honey Run Road, and the south end of which is the
V extension of the southwesterly boundary line of the property described in
Exhibit "A".
This conveyance is subject to the following conditions:

1. The property described in Exhibit "A" shall be used only as a fire
"J station site. The above-described easement shall be used only in connection
~j with the use of the property described in Exhibit "A" as a fire station site.
J Upon abandonment of usage of the property described in Exhibit "A" as a fire
.v station site, the property described in Exhibit "A" shall revert to Grantor,
as the owner of the adjacent property or to Grantor's heirs, successors and
d assigns with respect to ownership of such adjoining property. Upon such
DL abandonment, the above_specified easement shall terminate. For purposes of
this paragraph, a cessation of use of the property described in Exhibit "A"
tS"~ as a fire station site for a continuous period of one year shall be deemed
.Z to be an abandonment of usage as a fire station site.
~ 2. The fire station site on the property described in Exhibit "A" shall; at
all times, be known as the "Alm Site" or the 'Alm St tion". l9~

3. Prior to the construction of any building on the property
described in Exhibit "A", reasonable architectural approval
must be obtained by the Grantee from a committee selected by
the Grantor, or by the Grantor's successor in interest with
respect to the adjoining property. In the event o£ construction
of any such building without obtaining such approval, the property
described in Exhibit "A" shall revert to Grantor or to Grantor's
successor in interest with respect to the adjoining property,
and, in such event, the above-specified easement shall. terminate.
4. The Grantee's use of the above-specified easement shall
be limited to use of the existing road located upon and within
the strip of property which is subject to such easement. No
modification to said existing road, excluding normal maintenance,
may be made without the prior approval of the Grantor or of
the Grantor's successor in interest with respect to the adjoining
property.
5. This grant is made upon condition that the Grantee, or
the Grantee's successor in interest with respect to the property
described in Exhibit "A", complies with the conditions set
forth in paragraphs 1, 2, 3 and 4, above. In the event of
noncompliance with such conditions, then the Grantor, or her
heirs, successors and assigns with respect to the property
described in Exhibit "A", without paying any compensation for
any buildings or other improvements or betterments that may
then be upon said property, and without making any compensation
or incurring any liability for damage or losses of any kind,
shall have the power to terminate all right, title and interest
in the property granted by this deed of the County of Butte,
or its successors and assigns with respect to said property,
in the manner provided by law for the exercise of this power
of termination, and shall thereupon have and enjoy forever
all property granted by this deed, as if this conveyance had
not been made. In the event of exercise of this power of termination
and a resulting reversion, the property described in this deed
shall again become a part of the adjoining property of the
Grantor, or of the Grantor's heirs, successors and assigns
with respect to ownership of such adjoining property.
