BOARD OF SUPERVISORS_ CQUNTY QF BUTTE, STATE OF CALIFORNIA Resolufion No. 91-114 RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE APPROVING THE ADOPTION OF A GENERAL PLAN AMENDMENT TO THE CHICO AREA LAND USE PLAN, THE GRIDLEY AREA LAND USE PLAN, AND AN AMENDMENT TO THE BUTTE COUNTY GENERAL PLAN. WHEREAS, a private land owner, Michael Paisley, has petitioned the Butte County Planning Commission through an appropriate application; to amend the Butte County General Plan Land Use Element, for a change from Low Density Residential to Commercial for that property identified on Exhibit A-1 attached hereto; and WHEREAS, a private company, Yuba Sutter Disposal Incorporated, has petitioned the Butte County Planning Commission through an appropriate application, to amend the Butte County General Plan Land Use Element, for a change from Orchard and Field Crops to Industruzl for that property identified on Exhibit B-1 attached hereto; and WHEREAS, a private land owner, GCen Biggers, has petitioned the Butte County Planning Commission through an appropriate application, to amend the Butte County General Plan Land Use Element, for a change from Tunber Mountain to Agricultural- Residential and Commercial for that property identified on Exhibit C-1 attached hereto; and WHEREAS, the proposed General Plan Amendments have been studied and reviewed by the Butte County Planning Commission and public hearings have been held pursuant to law, at which time all interested persons were heard; and WHEREAS, the Butte County Board of Supervisors has reviewed and conszdered the contents of the environmental review study checklist (Exhibit A-2) prepared on the amendment for Michael Paisley pursuant to the California Environmental Quality Act; and WHEREAS, the Butte County Board of Supervisors finds that the proposed General Plan Amendment and subsequent development coulri not have a significant impact on the environment; and WHEREAS, the Butte County Board of Supervisors. has reviewed and considered the contents of the environmental review Study Checklist (Exhibit B-2) prepared on the amendment for Yuba Sutter Disposal Incorporated pursuant to the Ca&fornia Environmental Qualify Act,• and WHEREAS, the Butte County Board of Supervisors finds that the proposed General Plan Amendment anal subsequent development could have a potentially significant impact on the environment but wilC not in this case because of the mitigation measures which have been attached to the project and are described on Exhibit B-3; and WHEREAS, the Butte County Board of Supervisors has reviewed and considered the contents of the Draft Environmental Impact Report (Exhibit C-2) prepared on the amendment for Glen Biggers pursuant to the California Environmental Quality Act; and WHEREAS, the Butte County Board of Supervisors fiirds that the proposed General Plan Amendment and subsequent development could have a significant impact on the environment, but will not in this case because of the mitigation measures contained in that document as amended by the Butte County Planning Commission which have been attached to this project and are described on Exhibit C-3; and WHEREAS, the Butte County Board of Supervisors has held hearings on the General Plan Amendments at which ail interested parties were heard; and WHEREAS, the Butte County Board of Supervisors fouls the proposed Commercial General Plan amendment as shown on Exhibit A-1 complies with the policies of the Butte County General Plan specifically: 1. The Amendment provides for compatible development with existing land uses. 2. The land being changed to Commercial rs currently developed in a commercial nature. WHEREAS, the Butte County Board of Supervisors finds the proposed Industrial General Plan Amendment as shown on Exhibit B-1 complies with the policies of the Butte County General Plan specifically: Y. The amendment provides for compatible development with existing land uses. 2. The proposal is in keeping with the County's stated goals and policies for handling and storing hazardous or toxic materials. WHEREAS, the Butte County Board of Supervisors fvads the proposed Agricultural-Residential and Commercial General Plan amendment as shown on Exhibit C- I complies with the policies of the Butte County General Plan specifccally: I. The amendments provide for compatcble development with existing land uses. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors does hereby adopt and certify the Negative Declarations for the General Plan Amendment pursuant to the California Environmental Quality Act and that the Board of Supervisors does hereby adopt and certify the Draft Environmental Impact Report as final pursuant to the California Environmental Quality Act. NOW, THEREFORE, BE IT FURTHER RESOLVED that the land use designation from Low Density Residential to Commercial Tunber Mountain to Agriculturab Residentiai, Timber Mountain to Commercial and Orchard and Field Crops to Industrial, for those areas identified on Exhibits A-1, B-1, and C-1 attached hereto and incorporated 6y reference are hereby adopted and approved by the Butte County Board of Supervisors as an Amendment to the Butte County Land Use Element; said Amendments to be the land use policy for the County of Butte in the affected areas for all findings pursuant to law. BE IT FURTHER RESOLVED, that pursuant to Government Code Section 65359 the General Plan of the County of Butte is endorsed to show that the above amendment has been approved by the Board of Supervisors. YES MAYBE N6 Y G • `al V -k- PRO.TE~T DE~~PTIOI~ This project involves a General Plan Amendment, a Rezone, and a Use Permit to allow the siting of a household hazardous waste collection facility. The General Plan Amendment will be from Orchard and Field Crops to Industrial and the Rezone will be from P-Q to M-2. The hazardous waste collection facility will consist of an approved hazardous waste bin placed on a concrete containment pad. The facility will be open to Yuba Sutter disposal customers a minimum of one day per month. The project is located on the north side of Ord Ranch Road approximately 1/2 mile east of Highway 99, north of Gridley. The existing use on site is a solid waste transfer station. The property is owned by Butte County and is leased by the City of Gridley. The Yuba Sutter disposal provides solid waste pickup for the City of Gridley and also operates the transfer station far shipment of refuse to the Neal Road land fill. DISCU SIGN OF ENVIRONMENTAL EVALUATION AP # 025-190-050 lb,3b: The proposed General Plan amendment and rezone will allow uses that could have substantial disruption, compaction, and overcovering of the soil. Soil disruption will generally be limited to building site preparation. Overcovering could approach 70 to $0% of the site of the 3.7 acre site. This overcovering will result in increased runoff amounts and may require on site as well as off site drainage improvements. Approximately 1/4 of the parcel is currently over covered by paving or building structures. Yuba Sutter Disposal's immediate project will result in approximately 1500 square feet of additional paving or orrercovering. This is not a substantial amount and the additional runoff generated is not expected to be significant. This projec# is within Reclamation District No. 833. The Reclamation District's facilities currently have the capacity to handle any increased runoff. 1g: Approval of this project will result in approximate 3.7 acres of prime agricultural soil being ... lost to development. The site is not currently being utilized far agricultural purposes but is adjacent to several producing orchards. The conversion of this acreage is not considered to be significant. 2a,b: The rezoning of this property to allow industrial uses could result in some uses being located on site that could contribute locally to reduced air quality. All uses will be subject to state and local air duality requirements. Since the surrounding area is agricultural and there are few residences this should not be a significant affect. 3f: Since the project proposes staring household hazardous waste on site there will be a small possibility that there could be a spill or discharge that could reach the drainage system. All hazardous waste brought to the project site will be sorted according to type and will be sealed in approved 5S gallon drums with enough absorbent material #o contain any liquids. In addition, these drums will be stored in a double walled steel container and that container will be placed on a concrete pad with a 4 inch high containment wall. The concrete will be sealed to prevent any spills from soaking into the cement. With these precautions a spill seems unlikely. da,b: Changing zoning to M-2 will allow uses that could generate substantial amounts of noise. The existing use on site generates vehicular noise from large trucks and the loading and unloading of large garbage containers. Currently this noise is generated primarily on the week -5- ends when the transfer site is open for business. Future industrial uses could increase this noise level aver the entire week. This site is not in a noise sensitive area. There are few residents near the parcel. 7: Development of the site with industrial uses will result in additional outdoor lighting being installed. All outdoor lighting should be installed so as not to interfere with motorists an Ord Ranch Road or any neighboring residential use. 8: The current General Plan and zoning for the parcel is P-Q (Public-Quasi Public). This designation was placed on the property because it is owned by a public agency, Butte County. The allowed uses are determined by the needs of the public entity owning the property. Butte County will have the power to control what uses occur on site. While this provides some protection against development of the property, it does no# guarantee it. Once the General Plan and zoning are changed, it must be assumed that the property will eventually develop in accordance with the zoning adopted. Given the County's current financial situation and the possibility of County bankruptcy, the sale of this property as a result of a bankruptcy hearing is not an impossibility. The current use on site is a solid waste transfer station. Residents of the Gridley area can bring their refuse to the transfer station and it will then be transported to a land fll. This use is not expected to change in the near future and the addition of a household hazardous collection facility is an appropriate accessory use an site. The need for a General Plan amendment and rezone was dictated by the Butte County Hazardous Waste Management Plan which requires hazardous wastes facilities be located in industrial or commercial zones, In adopting a General Plan amendment specific policies should be included that will restrict ar revert the General Plan to orchard and field crops should the County transfer the property. This will insure that incompatible uses will not develop on site. 10a: There is some risk of release of hazardous substances associated with this project. Gridley .. residents will be bringing a variety of household hazardous wastes to the project site for disposal or recycling. At the site, trained personnel will inspect and classify the items. If items are unlabeled they will attempt to determine what type of chemical or hazardous ma#erial is in the container and label it properly. It is during this time that a spill is most likely to occur. This activity will be taking place an a sealed concrete pad that has a containment rim around it and is sloped to the center to collect any spilled materials. if a spill does occur, clean up will be initiated immediately. There will be four levels of containment far any hazardous material on site. The materials will be kept in their original containers which is then placed in an approved S5 gallon drum with absorbent material. The drum is then placed in the approved storage bin which is situa#ed on a sealed concrete pad that has a containmen# rim around it. This process will greatly reduce the chance of any spill or Ieak. 13a: The exact amount of traffic that will be generated from this project is not known. The possibilities range from none or very Iittle to a significant amount, depending upon future developments on the property. Under the proposed projec#, which is to add a household hazardous waste collec#ion facility to the site, little #raffic wiI1 be generated. Currently, the solid waste transfer station is open every weekend. The hazardous waste collection facility will be open one weekend per month. It is expected that most traffic volume will occur during the first -6- few weeks of#er it is opened as a result of people going through their garages and cleaning out wastes that have accumulated over the past years. The traffic should then thin out and it is expected that most people will bring their hazardous wastes when they have other items to bring to the transfer station. There wilt also be large trucks that will came to pick up the filled hazardous waste bins. The frequency of their visits will be determined by how much waste is collected but it is not expected to be more than four or five times a year. 'This traffic would be insignificant when compared to the large vehicles that are part of the current operation. 13b: Some new parking will be needed as a requirement of this project. The applicant proposes four new paved parking spaces that will be located near the hazardous waste bin. This is not seen as a significant amount of new parking and should be adequate to handle the expected demand. 14a: In the event of any major spill the Butte County Fire Department would most likely be asked to respond. The likelihood of this happening is not very great and the project should not result in any significant impacts to the County's fire protection system. There will be an inventory of all hazardous wastes stored on site. There will be a copy of the list kept at the site and one will be provided to the Tire department also. 15a,16a: Tf the property were to develop with other industrial uses there would be an increase in demand for fuel or power to the site. Tt is expected tha# Pacific Gas and Electric Company could meet that demand. 17a,b: Many of the hazardous wastes on site represent varying degrees of health hazards if handled improperly. All employees working with hazardous wastes will have to undergo training prior to employment. Once on the job, they will be wearing protective clothing and emergency equipment will be available on site in case of a f re, explosion or unplanned release of hazardous materials. All employees will also have #o undergo a medical evaluation prior to employment and once a year thereafter, MANDATORY FINDINGS OF SIGNIFICANCE: 2. The project does have the potential to achieve a short terse benefit to the detriment of long term environmental goals. The General Plan amendment and rezone will achieve a positive short term benefit which will allow the siting of a household hazardous waste collection facility. In the long term, this General Plan designation and zoning could become a detriment if the solid waste transfer station and household hazardous wastes collection facility were to close and other industrial development were to occur on site. This can be prevented by adopting specific General Plan policies which would require the County to amend the General Plan and rezone the property should it ever divest itself of the site. -7- ,U GE TED MITIGATI N MEASURES: 1. rnclude specific language in the General Plan policies which would cause the County to re-evaluate the General Plan designation and zoning should the property by sold by the County. The California Department of Health Services requires that all hazardous wastes collection facilities prepare and adhere to a detailed operating plan. 'This plan outlines normal and emergency operations tha# are to occur on site and emergency procedures that will #ake place in the event of an accident. This plan is very detailed and addresses most aI1 of the environmental concerns related to the hazardous waste collection facility. No hazardous waste facility shall operate without an Operation Plan approved by the California Department of Health Services and a Butte County Use Permit. The M-2 zoning shall remain in effect while the property is under ownership by Butte County. Structures shall be built to resist lateral movement as outlined in the requirements of the Uniform Building Code for Seismic Zone 3. Mobile homes shall be placed on permanent foundations. 2. Structures shall not be built in the mountain meadow areas, close to the banks of Butte Creek, on river terraces or the bluff north of the terraces. These areas shall be delineated on all recorded parcel maps or subdivision maps as "no-development" zones. 3. A note shall be placed on the final subdivision map stating that any fill developed during leveling of a site shall be compacted to 95% to discourage lurching, slumping, and differential settling. 4. Physical disturbance of the bluff north of Butte Creek shall be limited to work that is absolutely necessary to provide erosion control or drainage improvements as determined by the Butte County Public Works Department. Any cuts or alterations shall be revegetated and protected physically from stormwater erasion by straw, straw bales, or cobbles. 5. The 100-year flood plain elevation shall be established by a licensed engineer in accordance with FEMA requirements prior to recordation of the final subdivision map. A note shall be placed on the final subdivision map stating that the finished floor of any building must be at least 1 foot higher than this established flood elevation. b. All existing definable drainage channels shall be mapped by the project engineer and shall be preserved as drainage channels. Maintenance shall be the responsibility of the homeowners' association. 7. Existing drainage channels disrupted by development shall be replaced by canals or pipes. Any new canals shall be lined with rock to prevent erosion. $. All areas of soil exposed for construction shall be covered by buildings, paving, or with mulch (or similar material} before the onset of fall rains. 9. Runoff from paved surfaces used for commercial parking shall be directed through planted landscaped areas or into infiltration trenches, rather than be directly conveyed to the creek in pipes or ditches. This will release suspended particulates and reduce the impact upon Butte Creek. 10. A 100-foot setback shall be established from the riparian zone along Butte Creek, except where the vertical separation on Lots 22 and 25 provides an adequate setback area. A 1D0-foot setback shall be established from the edges of the two large meadows along the northern boundary, and a 5D-foot setback from the edge of the bluff north of Butte Creek. No residential development shall be permitted in these setback areas, the riparian zone or meadows. Setback lines shall be recorded on the deeds far each lot and show on the final recorded map. 1 ] . The integrity of the two drainageways leading from the larger meadows through Lots 1, 2, and 3 shall be maintained. Roadway crossings can be allowed if the drainageways are protected by culverts. 12. Locus 1 as listed in the archaeological report shall either be shown as a "No Development Zone" on the final map, or the developer may contract for additional field work and literature review to establish the real historic value of the site prior to tentative subdivision map approval. X3. Should any subsurface cultural remains or artifacts be encountered during construction activities on the site, work should be halted until a qualified archaeologist has made a determination of their significance. 14. A second emergency access route shall be provided to connect Lots 1 through 7 and 10 through 16 with Humboldt Road. This shall be an all-weather road on an easement form a lot in the series X3 through 1b, built to a road standard to be determined by the Butte County Public Works Department prior to acceptance of the final subdivision map. 15. The floating easement serving Lot 25 shall be defined on a specific, recorded easement route. 16. Vegetation removal shall be limited to that necessary for development and compliance with adopted fire safety regulations. 17. Roof materials shall be UL Class A or B. 18. Roadside strips of 10 feet shall be cleared of brush and maintained as cleared strips on all new roads through the project. 19. The pressurized water system shall be developed according to the design prepared by the BC/CDF Fire Department. 20. Construct all roads to County public road standards and offer them for dedication to the County. 21. Establish a County Service Area to address police and fire services covering at least the project area. 22. Establish a County Service area for snow removal services for the new roads constructed by this project. 23. Show the portion of Lot 22 east of Butte Creek as a "no-development" zone and provide an access easement. Also designate the 100 foot no-development setbacks along the creek as access easements.
