WHEREAS, the Butte County Board of Supervisors recognized
the tenuous circumstances of the County's financial stability; and
WHEREAS, the Butte County Board of Supervisors recognizes
that the citizens of Butte County place great value on local
governmental services, including adequate law enforcement and fire
protection; and
WHEREAS, the Butte County Board of Supervisors recognizes
the need for revenue that is exclusively for general, local
governmental services; and
WHEREAS, Section 7285, California Revenue and Taxation
Code, authorizes the Board of Supervisors to levy a utility user
tax on the consumption of electricity, gas, water, telephone and
telegraph services in the unincorporated area of the County; and
WHEREAS, Section 7285, California Revenue and Taxation
Code, authorizes the Board of Supervisors to reserve said tax for
local purposes as detern-ined by the Board of Supervisors that
imposes the tax; and
WHEREAS, such designation does not violate any California
statute or constitutional provision, including Article 13A;
THEREFDRE, BE IT RESDLVED that the Butte County Board of
Supervisors hereby expresses its intent that revenues collected
pursuant to any tax imposed pursuant to Section 7285, California
Revenue and Taxation Code, shall be reserved for general, local
governmental purposes, including, but not limited to, law
enforcement and fire protection services provided to residents of
the unincorporated area; provided, however, that the Board declares
that any such utility tax levy is a general tax and that all

revenue thereby collected shall be deposited into the County~s
General Fund; nothing in this resolution shall be deemed or
construed as an expression by the Board that the utility tax levy
is a special tax.
PASSED AND ADOPTED this 1st day of Octobers 1991, by the
Butte County Board of Supervisors by the following vote:
