HomeMy WebLinkAbout91-123 !, _ ~ ` ~ ~ ~~ ~ ,~a ~ _ ~= .~ ~ ~ :~: ~r~ ~so~s ~oai~ ~o~ o~ ~~suP 7l COUNTY "OF BUTTE, STATE OF CALIFOFNA a' k. ~',+~ RESOI,iTTION TO IMPLEMENT THE PROVISI'ON~fIOn No. ~'-323 OIL' GOVERNMENT CODS SECTION 75000(b) WHEREAS, it is incumbent on the Board. of Supervisors to provide adequate courthouse and criminal justice facilities; and WHEREAS, the- ability of the Board to acquire, rehabilitate, construct, finance, lease and maintain such facilities, and to provide for the payment or repayment of obligations entered into for such purposes, is severely strained by reason of limitations upon county revenues; and WHEREAS, to assist in the funding of court courthouse and criminal justice facilities, Section 76000{b) of the Government Code provides for the imposition of additional penalties for every parking offense where a parking penalty, fine or forfeiture is imposed and for the deposit of these penalties to the funds established for these purposes; and WHEREAS, Section 76000(b) of the Government Code becomes operative ugon adoption of a resolution by the Board stating that the provisions of this Section are necessary to the County for the purposes authorized; NOW, THEREFORE, the Board of Supervisors of the County of Butte does hereby resolve, declare and determine as follows: Z.. The foregoing recitals are adopted as apart of this resolution. 2. Implementation of the provisions of Section 76000(b) of the Government Code is necessary to .the establishment of adequate courthouse and criminal justice facilities in the County, and with respect to each authorized fund established pursuant to Section 76100 or 76101, for every parking offense where a penalty, fine, or forfeiture is imposed, an added penalty of two dollars and fifty cents ($2.50) shall be included in the total penalty, fine, -2- or forfeiture. 3. All penalties collected pursuant to Section 76000(b) of the Government Code shall be deposited as specified by Sections 76000(b) and 76000(c). 4. The Clerk of the Board of Supervisors is instructed to transmit a copy of this resolution to the judges of the courts of this County and to any entity within this County that processes and collects parking bail deposits with the request that the bail schedule amounts be increased as appropriate to reflect the penalties provided for by Section 76000(b) of the Government Code, effective October 1, 1991.
