BOARD OF_ SUF'ERV.ISORS .> COUNTY QF~ BUTTE, STATE OF CALIFORNIA Resolufion No. 91-141 RESOLUTION RELATING TO THE CONDITIONAL REZONING CLASSIFICATION FOR YUBA BUTTER DISPOSAL ON PROPERTY OWNED BY BUTTE COUNTY WHEREAS, a private applicant, Yuba Sutter Disposal, has requested a change in zoning elassificataon for real property, herein called the "Property", owned by Butte County and currently leased to the City of Gridley, which Property is described in Attachment A of this document; and WHEREAS, the Property is now zoned P-Q; and WHEREAS, an application for a reclassification of zoning of the Property has been received puxsuant to which application the Property is being reclassified from its present classification to M-2; and WHEREAS, in the absence of County control or ownership of the Property, the potential uses of the Property under the proposed zoning may be incompatible and detrimental to the surrounding property and inhabitants of Butte County; and WHEREAS, the Board of Supervisors may impose conditions to the zoning reclassification of the Property where it finds that said conditions may be imposed pursuant to Butte County Code Section 24-29; and WHEREAS, public hearings have been held upon said application before the Board of Supervisors of the County of Butte, State of California, and after having considered the matter presented, it has been determined that certain conditions to the zoning reclassification of said real property must be imposed so as not to create any problems inimical to the health, safety and the general welfare of the County of Butte. NOW, THEREFORE, it is understood that inasmuch as the reclassification specified above is being granted, the said reclassification shall be subject to the conditions specified in the following paragraphs: 1. That the conditions shall be applicable to the property and all leaseholders, assigns, or successor in interest to the property shall be subject to the following conditions: la. No hazardous waste facility shall operate without an Operation Plan approved by the California Department of Health Services and a Butte County Use Permit. 1b. The M-2 zoning shall remain in effect while the property is under ownership by Butte County. Transfer of the property to private ownership shall initiate a General Plan amendment and Rezone. OLPH, hief Administrative Officer and Clem, the Board, By ATTACHMENT A A portion of that certain parcel of land in Section 30, T1$N, R3E, MDB&M, which parcel was conveyed by deed recorded in Volume 1559 at Page 119, Official Records of Butte County, described as follows: Beginning at the southwesterly corner of that parcel of land conveyed by said deed; thence from said point of beginning S $9 ° 48' 39" E, 254.32 ft.; thence from a tangent that bears N 53 ° 19' 02" E, along a curve to the left with a radius of SOHO ft., through an angle of 23 ° 07' 39", an arc length of 20.18 ft.; thence continuing along a tangent curve to the right with a radius of 50.00 ft., through an angle of 59 ° 59' 58", an arc length of 52.36 ft.; thence S 89 ° 48' 39" E, 50.65 ft.; thence N 34 ° 02' 25" W, 167.4$ ft. to a paint distant 62$.79 ft. westerly, measured at right angles, from the "A" line at Engineer's Station "A" 289 + 63.20 of the Department of Public Works' Survey on Road 03-But-99, Post Mile 1.5/10.1; thence S 75 ° 20' S7" W, 277.07 ft.; thence S 00 ° 03' 39" E, 107.51 ft. to the point of begira~ning.
