HomeMy WebLinkAbout913ORDINANCE N0. 913 1 2 3 4 6 6 7 8 9 10 11 12 z3 14 15 16 17 18 19 2d 21 22 23 24 25 26 2'7 28 29 30 31 32 AN ORDINANCE P,EPEALING AND CONSOLIDATING ORDIPfAPdCE NOS. 437, 631, 6536, 845 and 906 AND ESTRBLI5HING REGULATINGS FOR THE USE OF LAND AND THE CONSTRUCTION AND USES OF BUILDINGS ALOi•1G THE SCENIC HIGHWAYS OF THE COUNTY OF BUTTE The Board of Supervisors of the County of Butte> State of Calif ornia, DOES OP,DAIN as follows: SECTION 1. Far the purpose of promoting the public health, safety and general welfare, and more particularly for the purpose of preventing the creation of traffic hazards, promoting the pros- perity of the people of the County of Butte, conserving land values' -along the Scenic Highways, promoting the comfort and happiness of the people of the County of Butte, fostering pride in and attach- ment to the said County, and promoting the public tranquility and good order thereof, preserving and enhancing the public scenic and aesthetic values, the Board of Supervisors of the County of Butte does hereby ordain and set forth an "S-H" (Scenic Highways) District and the following regulations established to govern the-uses of lane -and the construction and uses of buildings along the Scenic High- ways. SECTION 2. The provisions of an "S-H" (Scenic Highway) Distric~ shall apply to all property lying on each side and within three hun• Bred and fifty (350) feet from the centerline. of the following high• ways: a. State Highway 32, Chico: From Fir Street easterly to the Butte County line. b. State Highway 70, Oroville: From Wick's Corner north- easterly to the Butte County line. c. Pentz Road, Paradise: From State Highway 70 to the north- erly-most boundary of the Paradise Irrigation District. d. Clark Road, Paradise: From State Highway 70 to the north- erly-most boundary of the Paradise Irrigation District. e. Skyway, Chico-Paradise: From the west boundary of Section 4, Township 21 North, Range 2 East to the east boundary of Section 20, Thownship 22 North, P.ange 3 East. SECTION 3. REGULATIONS. 3.1 Uses permitted: a. Lawful uses of land now established. b. Residential dwellings and accessory buildings. c. Agricultural uses and buildings. d. The fallowing upon the securing of a Use Permit in each case: 1) Schools, churches, public utility buildings and structures, roadside stands for the sale of pro- duce from the land fronting the highway within the District. iu 1 2 3 4 6 6 7 8 9 10 I1 12 13 14 15 16 17 18 19 20 21- 22 23 24 25 26 2'7 28 29 30 33. 32 3.2 Additional uses permitted: Certain additional uses are permitted upon the securing of a use permit in each case; said uses are highway services primarily for the convenience of the traveling public and including: a. Gasoline service stations. b. Restaurants. c. Motels and Trailer Courts. d. Public and quasi-public buildings and professional buildings. SECTION 4. ADDITIONAL REGULATIONS. 4.1 The following regulations shall apply in all parts of said district: a. No building or structure shall hereafter be located within the district closer than fifty {5O) feet from the centerline of said highways, except where said highways are classified by the County as a Federal Aid Secondary road, the minimum building setback requirement shall be fifty-five (55) feet from the centerline of said road. b. Building Site Rrea: Each single family residence shall be located on a site..not less than eight thousand, one hundred and twenty-five (8,125) square feet in area. The minimum lot width shall not be less than sixty-five (65) feet, and the residence shall not be located less than five (5) feet from each side line of the building site. c. No signs, bi116oards or advertising displays shall be erected within the district except signs advertising only the sale or lease of land upon which sign is placed, or the pro- ducts grown or raised upon such property, and established or permitted uses an such property except the following: 1. DIRECTIONAL SIGNS: Are. permissive in advance of an entrance to a frontage road or intersection where bus- inesses that serve the highway users (ie. Phone, Roadside business, Hospitals, Motels, Rest Areas, Campgrounds and Next Services) are available and installed in accordance with State of California Division of Highways Planning 'P4anual of Instructions. 2. HISTORICAL LANDMARK SIGNS: Are permissive in ad- vance of an entrance to a frontage road or intersection with~the most direct access road to guide traffic to a registered landmark and installed in accordance with State of California Division of Highways Planning hlanual of Instructions. d. Off-street Parking: Off-street parking area shall be as required by .the Planning Commission. 1 2 3 ' 4 5 6 7 S 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 2'7 28 29 30 31` 32 SECTION 5. Use Permits, Variances and Rezoning: The application for a use permit, variance or re-zoning shall be made to the Planning Commission for a recommendation and such application shall include a description of the requested use and shall be accompanied by plans showing the location and ele- vations of the proposed buildings or proposed alterations, location of driveways and parking area, advertising matter or structures and other information which may be required by the Planning Commission. The Board of Supervisors shall. act upon such application upon the receipt of the application from the Planning Commission. SECTION 6. All uses of land within the district not specifi- cally authorized and permitted are prohibited. ', SECTION 7. Butte County Ordinance Nos. 437, 631, 6536, 845 and 906 are hereby repealed. SECTION 8. The penalties for any violation of the zoning here- by imposed within the district shall be as provided in the.Zoning Enabling Ordinance. In compliance with the provisions of the Zoning Enabling Ordinance, this Ordinance shall from and after its effective date become a supplement to and part of the Zoning Enabling Ordin-once. SECTION 9. This Ordinance shall take effect immediately upon its passage, and before the expiration of fifteen (15) days after its passage shall be published once with the names of the members voting for and against it in the Chico En~exprise a newspaper published in the County of Butte, State of Ca ifornia.
