HomeMy WebLinkAbout917_, =~' ~, ORDINANCE N0. 917 1 2' 3 4 5 6 7 8 9 10 I1 12 13 14 15 is 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 AN ORDINANCE OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, ZONING A PORTION OF SAID COUNTY PURSUANT TO ORDINANCE NOS. 475, 522 and 676 OF SAID COUPdTY The Board of Supervisors of the County of Butte, State of Cali- fornia, under and pursuant to Ordinance No. 475 of said County, being the Zoning Enabling Ordinance as amended by Ordinance Plos. 522 and 676, DO ORDAIP! as follows: SECTION 1. The hereinafter described area situate in the County of Butte, State of California, shall be and it is hereby zoned as an "R-3" (Medium-Density Residential) District and such area sha17 be subject to the restrictions and restricted uses and regulations hereinafter specified and provided. Said area so zoned being lo- cated in the unincorporated area of Butte County, west of the City of Oroville, California, and particularly described as follows: As shown by map attached and as shown by the Butte County Area flap No. 4-P in the .Office of the Butte County Planning Commission and the Office of -the Butte Cnunty Clerk. SECTION 2. REGULATIONS FOR APl "R-3" DISTRICT. The following regulations shall apply in an "R-3" District: 2.1 USES PERP•9ITTED: a. One-family dwellings, tUao-family dwellings and multi- family dwellings, not including tents or trailers. b. Accessory buildings. c. Household pets, (but not including livestock, poultry or poisonous reptiles.}. 2.2 BUILDING SITE AREA REQUIPED: ftinimum building site shall not be less than eight thousand, one hundred and tarenty-five (8,125) square feet. 2.3 hilPaItdUM BUILDING SITE GlIDTH RE(UIRED: P9inimum lot tividth shall not be less than sixty-.five {65) feet. 2.4 t+;INIMUM FRONT YARD REQUIRED: Minimum front yard shall be fifty (50) feet from the centerline of the road, except where the road is classified by the County as a Federal Aid Secondary Road, the minimum building setback requirement shall be fifty-five (55) feet from the centerline of said road. 2.5 MIN•IMUP~t SIDE YP,RD.REQUIREMENTS':~ Minimum side yard shall not;beless-tfi'an five {5) •feet. 2.6 OFF-STREET PARKING REQUIREl41ENTS: Off-street parking shall be submitted to the Planning Department for approval. The minimum off-street parking area shall be as follows: a. Churches - Ono (1} parking space for each four (4) seats in the principal place of the assembly of worship. b. Dwellings - One {1) parking space far each dwelling unit. r,. Hospitals and sanitariums - One (1) parking space for ea.ch:: tyvo (2r). beds. ~, d. Rest homes, convalescent homes, homes for the aged - One (1) parking space for each four (~) beds. 2 The parking requirements for a use not provided for in this 3 section shall be determined upon the requirements for the most com- parable as specified herein. 4 2.7 The following uses subject to securing a use permit in 5 each case: g a. Golf courses and country clubs. q b. Public and quasi-public uses, including churches, firehouses, hospitals, parks and playgrounds, schools and public g utility buildings. g; c. Rest homes, convalescent homes, homes far the aged and sanitariums. la SECTIOEV 3. A11 uses of land within the District not specific- 11; ally authorized and permitted in Section 2 are prohibited. 12 SECTION 4. In compliance with the provisions of said Zoning Enabling Ordinance, the same is hereby amended by and adding to 13 Section 5 thereof this Ordinance in full. 1~ SECTION 5. The penalties for the violatjon of the zoning .hereby imposed within the District shall be as provided in the Zoning En- 15' abling Ordinance. In compliance with the provisions of the Zoning Enabling Ordinance, this Ordinance shall from and after its effect- ~.6 ive date become a supplement tp and part of the Zoning Enabling Ordinance. 17 SECTION 6.
