RESOLUTION GIVING NOTICE OF HEARING ON PETITION
TO ABANDON A PUBLIC SERVICE EASEMENT
(PUE on Lots 35 & 36 of Indian Meadows Sub.,
Unit No. Two, and on Lots 6 & 7 of Schott Sub., Magalia)
WHEREAS, this Board has received a petition from five or
mare free-holders, requesting the abandonment of a public service
easement as described below, and at least one of the petitioners is
a resident of the township in which said public services easement
is situated; and
WHEREAS, pursuant to Chapter 3 of Part 3 of Division 9 of
the California Streets and Highways Code, commencing with Section
8320, this Board shall set a date, hour and place for a hearing on
the petition for abandonment.
NOW, THEREFORE, BE IT RESOLVED by the Board of
Supervisors:
1. That this Board hereby gives notice that at its
regular meeting on March 10 1992, at 10:15 a.m. ,
in the Board Chambers, Butte County Administration Building, 25
County Center Drive, Oroville, California, a hearing shall be held
to hear all persons interested in the abandonment of that certain
public service easement located in the unincorporated area of the
County of Butte State of California, identified as a public
utility easement on Lots 35 & 36 of Indian Meadows Sub, Unit No.
Two and on Lots 6 & 7 of Schott Sub. {AP# 66-42-4 & 5 & AP# 66-
51-23 & 24), Magalia, and more particularly described as follows:
PARCEL I
A portion of Lots 35 and 36, as shown on that certain map entitled,
"INDIAN MEADOWS SUBDIVISION NO. TWO", which map was filed in the
Office of the Recorder of the County of Butte, State of California
on December 17, 1971 in Book 38 of Maps at Pages 78 and 79 and more
particularly described as follows:
A strip of land 3.00 feet in width lying 1.50 feet on each side of
the following described line:
BEGINNING at the Northwest corner of said Lot 35, thence along the
boundary line between said Lots 35 and 36 South 15 22' 45" East,
19.70 feet.
PARCEL II
A portion of Lots 6 and 7, as shown on that certain map entitled,
"SCHOTT SUBDIVISION", which map was filed in the Office of the
Recorder of the County of Butte, State of California on August 11,
1981 in Book 80 of Maps at Pages 96, 97 and 98 and more
particularly described as follows:
A strip of land 6.00 feet in width lying 3.00 feet on each side of
the following described line:
BEGINNING at the Southeast corner of said Lot 6, thence along the
boundary line between said Lots 6 and 7; North 72 29' 44" East,
25.32 feet.
2. That a map showing the public service easement to be
abandoned is on file in the Office of the Butte County Department
of Public Works, 7 County Center Drive, Oraville, California 95965.
3. That at the conclusion of said hearing the Board
intends to abandon said public service easement,
4. That this abandonment proceeding is being conducted
pursuant to Chapter 3 of Part 3 of Division 9 of the California
Streets and Highways Code (commencing with Section 8320}.
5. That this Resolution be posted and published pursuant
to the provisions of Chapter 3 of Part 3 of Division 9 of the
California Streets and Highways Code.
PASSED AND ADOPTED by the Butte County Board of
Supervisors this 28th day of January 1g92, by
the following vote:
