OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA
IN THE MATTER OF ELECTING TO BECOME SUBJECT TO THE
PROVISIONS OF THE TRIAL COIIRT PROGRAM FOR THE
FISCAL YEAR JULY 1, 1992 THROUGH JIINE 30, 1993
WHEREAS, the State ^f California has enacted legislation
which amended and added Chapter 13 commencing with Section 77000
to Title 8 of the Government Cade, known as the Brown_Presley Trial
Court Funding Act, and such legislation, allows an option county
to receive from the state quarterly block grants based on sums
specified pursuant to Government Code Section 77200; and
WHEREAS, the Brown-Presley Trial Court Funding Act
establishes a program of state funding of trial courts as specified
in Government Code Section 77300; and
WHEREAS, the decision by the County of Butte to apt into
the program pursuant to Government Code Section 77300 shall result
in the option county agreeing to perform all duties and provide
services required within the Brown-Presley Trial Court Funding Act
and all other provisions of law;
NOW, THEREFORE BE IT RESOLVED, the chair of the Board of
Supervisors, the presiding judge of the Superior Court, and the
presiding judge of the Municipal Court District of the County of
Butte hereby elects, pursuant to Government Code Section 77301 to
opt into the Trial Court Funding Program for the 1992/93 fiscal
year beginning July 1, 1992, and agrees to be bound by the
provisions of this program in consideration far state funding of
trial courts; and certifies that a majority of each of the Board
of Supervisors, the judges of the Superior Court, and the judges
of the Municipal Courts in the county requests state funding.
BE IT FURTHER RESOLVED, the Chair of the Board of
Supervisors is authorized to sign a Letter of Understanding between
the Board of Supervisors and the presiding judges of the Superior
and Municipal. Courts.
The Clerk of the Board is directed to notify the
Secretary of State and the State Controller forthwith of this
election.

LETTER OF UNDERSTANDING
The provisions of this Letter of Understanding pertain to Fiscal
Year 1992-93 and the following budget units:
239-001 Superior Court Mediation Services
241-001 Superior Court
243-001 North County Municipal Court
245-001 South County Municipal Court
248-001 Court Work Referral Program
311-001 County Clerk
331-001 Court Reporters
1. The Board of Supervisors agrees to study for classification
and compensation purposes the positions of Municipal Court
Clerk/Administrator, Superior Court Administrative Officer, and
County Clerk Fiscal Administrator by using the ten counties
utilized in the Nash study and looking at comparable positions
without regard to job title. If adjustments are warranted, pay
will be set at 5% lower than the median of comparable positions.
The study will begin immediately and implemented no later than the
first full pay period in Fiscal Year 1992-93, Salary adjustments
will be funded from the funds available through the Trial Court
Funding formula.
2. There shall be flexibility to transfer funds between line
items, subject to normal and customary budgetary procedures, and
availability of appropriations within the respective budget units.
The above budget units may request budget transfers between budget
units subject to approval of a majority of the presiding judges in
superior and municipal courts, normal budgetary controls and
procedures, and availability of funds within Trial Court Funding
(Fund 60).
3. The budget units shall be subject to administrative review in
the filling of vacant positions. The Administrative Office shall
review Requests for Certification with respect to availability of
appropriations within a specific budget unit, current staffing, and
departmental needs.
4. Within Fund 60, carry over of fund balances to FY 92-93 is
assured, provided that should there be deficits in any of the above
budget units, the Fund 60 balance shall first be used to cover
those deficits. Any funds not already expended, disbursed, or
encumbered by June 30, 1992, shall be encumbered far use within
the Trial Court funding budget units for one-time expenditures in
the subsequent year.
Letter o€ Understanding
5. Creation of any new positions, such as referee, commissioner,
or electronic recording transcriptionist will be considered within
the funds available through the Trial Court Funding formula.
Current staffing levels are guaranteed to the extent that they can
be supported within the Trial Court Funding formula.
6. There shall be a liaison committee consisting of two members
of the Board of Supervisors, the presiding judges of the Superior
and Municipal Courts, the Administrative Office, and staff as
required. The committee shall meet quarterly to discuss items of
mutual concern.
7. The Administrative Office will facilitate a meeting between
the courts, the Auditor-Controller, and the Butte County Sheriff
to discuss appropriations and expenses in Account 554 (Interfund
Expenditures) and ISF accounts.
9. North County Municipal Court sha11 have position allocation
adjusted from Senior Account Clerk/Account Clerk to Accounting
Specialist/Senior Account Clerk.
10. The Administrative Office will facilitate a meeting between
the courts, the Auditor-Controller, and District Attorney to ensure
that the department issuing subpoenas is charged far all witness
fees and expenses related to that subpoena.
11. The County Clerk and Administration will identify the source
of $54,595 within 311.001.554, and if Trial Court Funding
allocation, it will be used to acquire fixed assets, namely,
computer needs to establish a communication link between all
courts, including Paradise and Gridley.
