HomeMy WebLinkAbout92-028Reso~uf2on WHEREAS, this matter came on regularly for hearing before the Board of Supervisors of the County of Butte, State of California, on March IO 1992, in the Berard Chambers, Butte County Administration Building, Oroville, California; and, WHEREAS, it appearing to said Board that notice of the time and place of the hearing on the petition for the abandonment of the public service easement in question was duly and regularly given as required by law; and, WHEREAS, testimony and evidence, both oral and documentary, having been produced at said hearing, from which said Board now finds that the hereinafter described public service easement is unnecessary for present or prospective public use. NOW, THEREFORE, TT IS HEREBY ORDERED as follows: 1. That the public service easement situated in the County of Butte, State of California, as hereinafter more particularly described, is hereby abandoned pursuant to Chapter 3 of Part 3 of Division 9 of the California Streets and Highways Code (commencing with Section 8320). 2. That said public service easement so abandoned is located in the unincorporated area of the County of Butte, State of RESOLUTION ABANDONING A PUBLIC SERVICE EASEMENT (PUE on Lots 35 & 36 of Indian Meadows Sub., Unit No. Two, and on Lots 6 & 7 of Schott Sub., Magalia) California, is identified as a public utility easement on Lots 35 & 36 of Indian Meadows Sub. Unit No. Two and on Lots 6 & 7 of Schott Sub. (AP 66-42-4 & 5; 66--51-23 & 24), Magalia, and is more particularly described as follows: PARCEL I A portion of Lots 35 and 36, as shown on that certain map entitled, "INDIAN MEADOWS SUBDIVISION UNIT NO. TWO", which map was filed in the Office of the Recorder of the County of Butte, State of California on December 17, 1971 in Book 38 of Maps at Pages 78 and 79 and more particularly described as follows: A strip of land 3.00 feet in width lying 1.50 feet on each side of the following described line: BEGINNING at the Northwest corner of said Lot 35, thence along the boundary line between said Lots 35 and 36 South 15 22' 45" East, 19.70 feet. PARCEL II A portion of Lots 6 and 7, as shown on that certain map entitled, "SCHOTT SUBDIVISION", which map was filed in the Office of the Recorder of the County of Butte, State of California on August 11, 1981 in Book 80 of Maps at Pages 96, 97 and 98 and more particularly described as follows: A strip of land 6.00 feet in width lying 3.00 feet on each side of the following described line: BEGINNING at the Southeast corner of said Lot 6, thence along the boundary line between said Lots 6 and 7; North 72 29 ~ 44" East, 25.32 feet. 3. That a ~ltap showing the public service easement hereby abandoned is on file in the Office of Butte County Department of Public Works; 7 County Center Drive, Oroville, California 95965. 4. That the Clerk of this Board shall cause a certified copy of this Resolution, with the seal of the Board of Supervisors of the County of Butte, State of California, to be recorded in the office of the Recorder of the County of Butte, State of California.
