RESOLUTION GIVING NOTICE OF HEARING ON PETITION
TO ABANDON A PUBLIC SERVICE EASEMENT
(PUBLIC UTILITY AND RECREATIONAL EASEMENT,
PARADISE PINES UNIT 12, MAGALIA)
WHEREAS, this Board has received a petition from five or more
free-holders, requesting the abandonment of a public service
easement as described below, and at least one of the petitioners is
a resident of the township in which said public service easement is
situated; and
WHEREAS, pursuant to Chapter 3 of Part 3 of Division 9 of
California Streets and Highways Code, commencing with Section 8320,
this Board shall set a date, hour and place for a hearing on the
petition for abandonment.
NOW, THEREFORE, BE TT RESOLVED by the Board of Supervisors:
1. That this Board hereby gives notice that at its regular
meeting on ~lun3 9 1992, at J.O:QO a.m. , in the
Board Chambers, Butte County Administration Building, 25 County
Center Drive, Oroville, California, a hearing shall be held to hear
all persons interested in the abandonment of that certain public
service easement located at Magalia in the unincorporated area of
the County of Butte, State of California, on property identified as
Lots 218 and 219 Paradise Pines, Unit 12, AP 064-020-057 and 064-
020-058, and more particularly described as follows:
Being that certain 12 ft. Public Utility Easement and Recreational
Easement lying within Lots 218 and 219 of Paradise Pines, Unit 12,
lying within a portion of Section 23, T23N, R3E, M.D.B. & M. as
shown on the map of Paradise Pines Unit 12, recorded in Book 38
Maps of Record at Pages 24 through 27, County of Butte, State of
California, more particularly described as follows:
Being that certain 12 ft. Public Utility Easement and Recreational
Easement lying south of, parallel with and contiguous to the north
lot line in Lots 218 and 219 of said Unit 12, beginning at the
northwest corner of said Lot 218; thence S 89 degrees 56' 04" E
along the north lot line of said Lots 218 and 219, 141.11 ft. to a
point; thence continuing along said lot line S 89 degrees 51' 48"
E 43.84 ft. to the northeast corner of said Lot 219 and the end of
the described easement.
2. That a map, showing the public service easement to be
abandoned is an file in the Office of the Butte County Department
of Public Works, 7 County Center Drive, Oroville, California 95965.
3. That at the conclusion of said hearing the Board intends
to abandon said public service easement.
4. That this abandonment proceeding is being conducted
pursuant to Chapter 3 of Part 3 of Division 9 of the California
Streets and Highways Code (commencing with Section 8320).
5. That this Resolution be posted and published pursuant to
the provisions of Chapter 3 of Part 3 of Division 9 of the
California Streets and Highways Code.
