WHEREAS, pursuant to Government Code Section 25365 the Board of
Supervisors may, by a four-fifths vote, grant, convey, or otherwise
transfer to a city _within the county any real property ar interest
therein belonging to the County upon such terms and conditions as are
agreed upon, if the property or interest therein to be granted and
conveyed is not required for county use; and
WHEREAS, the County of Butte acquired fee title to certain real
property for the purpose of realigning Dayton Road between Devaney
Avenue and Archer Avenue in the Chico area; and
WHEREAS, said property acquired included the easterly 33 feet of
Lots 1, 2, 3, 4 and 5 of Block A, according to that certain map entitled
"Archer's Addition to the Town of Chico," which map was recorded in the
office of the Recorder of the County of Butte, State of California,
February 17, 1904, in Map Book ~ at page 12; and
WHEREAS, the said easterly 33 feet of said Lots 1, 2, 3, 4, and 5
lies within and is subject to road rights-of-way, with a portion thereof
being within the right-of-way for the farmer alignment of Dayton Road
and the remaining portion thereof being within the right-of-way for the
current alignment of Dayton Road; and
WHEREAS, the said easterly 33 feet of said Lots 1, 2, 3, 4, and 5,

(DAYTON ROAD RIGHT-OF-WAY)
excepting the southerly 25 feet of said Lot No. 5, has been annexed to
the City of Chico and is not required for county use; and
WHEREAS, Notice of Intention to Canvey the said easterly 33 feet
of Lots 1, 2, 3, 4, and 5, excepting the southerly 25 feet of said Lot
No. 5, has been duly published pursuant to Government Coda Sections
25365 and 6061..
NOW THEREFORE, BE IT RESOLVED, that the easterly 33 feet of Lots 1,
2, 3, 4, and 5 of Block A according to that certain map entitled
"Archer's Addition to the Town of Chico," which map was recorded in the
Office of the Recorder of the County of Butte, State of California,
February 17, 1.904, in Map Book 4 at page 12, excepting therefrom the
southerly 25 feet of said Lot No. 5, shall be conveyed to the City of
Chico by grant deed in the form attached hereto as Exhibit A.
BE IT FURTHER RESOLVED that the Chair of the Board of Supervisors
is authorized to execute said grant deed on behalf of the County of
Butte.
