RESOLUTION OF THE BOARD OF SUPERVISORS
OF THE COUNTY OF BUTTE
ADOPTING A STANDARD OF AID FOR
GENERAL ASSISTANCE PURSUANT TO
WELFARE AND INSTITUTIONS CODE SECTION 17000.5

WHEREAS, pursuant to the provisions of Welfare and
Institutions Code Section 17000, the County of Butte is obligated
to relieve and support all incompetent, poor, indigent persons and
those incapacitated by age, disease, or accident lawfully resident
therein, when such persons are not supported and relieved by their
relatives or friends, by their awn means, or by state hospitals or
other state or private institutions; and,
WHEREAS, the County of Butte has entered into a Consent
Decree approved by the Butte County Superior Court whereby it is
required to provide aid and care for those individuals eligible for
General Assistance as set forth in that Consent Decree which said
Decree, as to levels of aid of and care expires on or about August
31, 1992; and,
WHEREAS, the State of California, through the passage of
Welfare and Institutions Code Section 17000.5 effective June 30,
1991, has authorized the Board of Supervisors in any county to
adopt a general assistance standard of aid that is sixty-two
percent (52%) of a guideline that is equal to the 1991 Federal
Official Poverty Line and to adjust that guideline in an amount
equal to any adjustment provided under Chapter 2 {commencing with
Section 11200} of part 3 of the Welfare and Institutions Code for
establishing a maximum aid level in the county, which said level
shall constitute a sufficient standard of aid pursuant to Welfare
and Institutions Code Section 17001, and further,
WHEREAS, Welfare and Institutions Code Section 17000.5
also authorizes an adjustment of that guideline in an amount equal
to any adjustment provided under Chapter 2 (commencing with Section
11200} of Part 3 of the Welfare and Institutions Code for
establishing a maximum aid level in the County and, in 1,991., the
California State Legislature adjusted the amount provided under
Chapter 2 (commencing with Section 11200) of Part 3 in the amount
of four and four-tenths percent (4.4 percent),
NOW, THEREFORE, it i.s hereby resolved as follows:
1. That the County of Buttes adopt as a standard of aid
pursuant to Section 17000.5 a maximum grant level equal to sixty-
two percent (62 p) of the 1991 Federal Official Poverty Line.
2. This amount shall be adjusted immediately by
reducing the max~.mum grant level downward by four and four-tenths
percent (4.4 percent) as authorized by Welfare and Institutions
Code Section 17000.5.
3. This amount may be adjusted annually in an amount
equal to any adjustment provided under Chapter 2 (commencing with
Section 11200) of Part 3 of the Welfare and Institutions Code.
4. This resolution shall be effective as of
September 1, 1992 and the General Assistance maximum aid levels
shall be adjusted as of that date.
5. There shall be added to the General Assistance
Manual utilized by the Butte County Welfare Department, Attachment
A hereto setting forth the new general assistance rates and the

Welfare Department is directed to implement the rates contained
therein effective September ~., 1.992.
5. Nothing contained in this resolution is intended to
affect the right of the County of Butte to implement in any manner
permissible by law or subject to the discretion of the Board of
Supervisors any change in law effective after the date of this
resolution which permits counties to further adjust or eliminate
General Assistance aid levels.
PASSED AND ADDPTED on the 18th day of August, 1992 by the
Butte County Board of Supervisors by the following vote:

C. BOARD AND ROOM may be paid to other than a responsible
relative, to a maximum of $300.00 {shelter, food, utilities).
A cash needs check ($27.00) shall be authorized as ~a direct
payment.
