HomeMy WebLinkAbout92-112~' hesolufion RESOLUTION OF THE BUTTE COUNTY BOARD OF SUPERVISORS APPROVING THE THIRD AMENDMENT TO THE AGREEMENT FOR THE CONTINUATION OF THE BUTTE COUNTY ASSOCIATION OF GOVERNMENTS WHEREAS, the parties to the Agreement for the continuation of the Butte County Association of Governments desire to amend the Agreement to permit the Association to hire an Executive Director and staff; NOW, THEREFORE, the Butte County Board of Supervisors does resolve as follows: Section 1. That certain Third Amendment to the Agreement for the continuation of the Butte County Association of Governments, attached hereto and incorporated herein, is hereby approved. Section 2. The Chair of the Board of Supervisors is hereby authorized and directed to execute this amendment on behalf of the County of Butte. THIRD AMENDMENT TO THE BUTTE COUNTY ASSOCIATION OF GOVERNMENTS AGREEMENT The Agreement for the Continuation of the Butte County Association of Governments dated November 26, 1979 and amended on March 12, 1980 and on August 18 J, 1987, is hereby amended as follows: RECITAL The parties desire to amend the Agreement for the continuation of the Butte County Association of Governments to permit the Association to employ an Executive Director and staff and to provide that the Executive Director shall serve as the Secretary to the Association. AGREEMENT 1. Article XI of the Agreement for the Continuation of the Butte County Association of Governments is hereby amended to read as follows: ARTICLE XI - SECRETARY OF THE ASSOCIATION The Secretary of the Association shall be the Executive Director who shall be responsible for the preparation of the agenda for meetings of both the Governing Board and the Metropolitan Planning Area committee, the taking of minutes for both the Governing Board and the Metropolitan Planning Area Committee, and the keeping and maintaining of all files and records of the Association. 2. Article XII of the Agreement far the Continuation of the Butte Gounty Association of Governments is hereby amended to read as follows: ARTICLE XII - ASSOCIATION EXECUTIVE D~RECTOR~ STAFF AND CONSULTANTS The Governing Board shall appoint an Executive director who shall serve at the pleasure of the Governing Board. The Executive Director shall be the Chief Executive Officer of the Association and shall have those duties as may be prescribed by either the Governing Board or the Metropolitan Planning Area Committee. The f Executive Director shall employ such other staff as necessary to accomplish the Association's purposes, consistent with annual budget. The Executive Director shall be responsible for all projects and property of the Association. The governing Board may adopt personnel rules and compensation plans as it deems necessary or appropriate. The Association may also employ consultants and providers of technical services when the employment of such consultants or providers of technical services has been approved by either the Governing Board or the Metropolitan Planning Area Committee and such services -are necessary for the implementation of their respective powers and functions. 3, All other provisions of the Agreement for .the continuation of the Butte County Association of Governments, as amended, shall remain in effect.
