WHEREAS, pursuant to Government Code Section 25365 the Board of
Supervisors may, by a four-fifths vote, grant, convey, or otherwise
transfer to a city within the county any real property or interest
therein belonging to the County upon such terms and conditions as are
agreed upon, if the property or interest therein to be granted and
conveyed is not required for county use; and
WHEREAS, the County of Butte acquired a 33 foot wide road right of
way far the former alignment of Dayton Road lying generally between
Devaney Avenue and Archer Avenue in the Chico area; and
WHEREAS, that portion of said road right of way which is described
in Exhibit A attached hereto and incorporated herein by this reference
has been annexed to the City of Chico and is no longer required for
county use; and
WHEREAS, said portion of said road right of way was incorrectly
described in Resolution No. 92-100; and
WHEREAS, a corrected Notice of Intention to Convey the said portion
of said right of way has been duly published pursuant to Government Cade
Sections 25365 and 6062.
NOW THEREFORE, BE TT RESOLVED, that the said portion of the right
of way for the former alignment of Dayton Road shall be conveyed to the

City of Chico by Quit 41aim Deed in the form atta__~ed hereto as Exhibit
A.
BE IT FURTHER RESOLVED that the Chair of the Berard of Supervisors
is authorized to execute said Quit Claim Deed on behalf of the County of
Butte.
BE IT FURTHER RESOLVED that Resolution No. 92-100 is hereby
rescinded.
PASSED AND ADOPTED by the Butte County Board of Supervisors this
22nd day of September, 1992, by the following vote:
AYES: supervisors Fulton, Houx, McInturf, McLaughlin and Chair Aolan
NOES : None
ABSENT: None
NOT VOTING: None

The Westerly 33 feet of said .night of way, Beginning at the Easterly extension of
the Northerly right of way line of Archer Avenue running Northerly parallel with
and westerly of the centerline of said Dayton Road to the Easterly extension of
the Northerly line of "Archers Addition to the City of Chicd' as shown on that
certain map recorded in Book of Maps #4, at Page 12, in the office of the Recorder,
County of Butte, State of California.
