RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE
APPROVING TERMINATION OF THE SITE LEASE AND FACILITY LEASE
BY AND BETWEEN THE COUNTY AND THE BUTTE COUNTY LIBRARY
CORPORATION AND THE ASSUMPTION OF LIABILITY, ASSETS AND PROPERTY
WHEREAS, the Butte County Library Corporation has instituted
proceedings for its dissolution; and,
WHEREAS, the Library Corporation intends to and will terminate
both -the facility lease and the site lease by and between the
Corporation and the County, said leases set forth in the document
entitled "Butte County Library Corporation Series of 1981 Bonds,
Basic Legal Documents;" and,
WHEREAS, the Butte County Library Corporation intends to and
will transfer any and all of its assets and property, whether
tangible, personal, or other, and any and all liabilities to the
County of Butte without reservation or exception; and,
WHEREAS, the Butte County Board of Supervisors has duly
considered all the above:
NOW, THEREFORE, BE IT RESOLVED as follows;
1. That the County of Butte accept and agree to the
termination of both the site lease and facility lease by and
between the County and the Butte County Library Corporation, said
leases terminating upon the effective date of dissolution of th.e
Corporation;
2. That, in light of the Corporation's dissolution, that the
County does hereby accept, without reservation or exception, all
assets and property, whether real, personal or other, as well as
all liabilities of the Butte County Library Corporation; said
transfer effective upon the effective date of the dissolution of
the Library Corporation.
PASSED AND ADOPTED by the Board of Supervisors of the County
of Butte, State of California, on the6tlday of October 1992 by the
following votes:
AYES: Supervisors P'EcInturf, Houx, McLaughlin, Fulton and Chair Dolan
NOES ; None
ABSENT: None
NOT VOTING: None
