HomeMy WebLinkAbout92-147y.~~ COUIVTY~ OF' ~UT1"~; ~-`TA~E O~ CACI~ORN#A ~` ' s 0 ~eso~ufion No. 92-147 RESOLUTYON APPROVING BAD CHECK ALTERNATIVE PROSECUTION PROGRAM OF THE DISTRICT ATTORNEY AND AUTHORT7TNG EXECIITTON OF A LEASE FOR SOFTWARE SYSTEM FOR 5UCH PROGRAM WHEREAS Chapter. 2.9A of Title 6 of Part ?_ of the Califnrnia Penal. Cade authorises the district attorney of a Califarni.a r..ounty to create a program for persons who write and/ar pass bad checks in the r_ounty which will allow such persons to avoid criminal prosecution upon meeting certain condi.tians, including, but not necessarily limited to, the payment of restitution nn such bad checks, the payment of statutory fees to the district attorney, and the attendance and completion af. remedial classes; WHEREAS the District Attorney has devised and put together such a program under Chapter 2.9A of Title 6 of Part 2 of the Penal Cade which will. utilize an automated rase management system developed by Computer Support Services of Citrus Heights, California; WHEREAS the COStS of such program will. be borne solely by the fees generated from the operation of the program and the util.i.zation of existing District Attorney staff usually assigned to investigate and prosecute had check cases; WHEREAS the Board of Supervisors pursuant to Ser.tion 1001.64 of Chapter ?_9A of Title 5 of Part 2 of the Penal Code must declare funds for such program to be available; and WHEREAS the Board of Supervisors recognizes that the issuance and passing of bad checks within Butte County has a highly negative impact upon the economy of Butte County; NOW, THEREFORE, BE TT RESOLVED that, to the extent the costs of the District Attorney's Bad Check Alternative Prosecution Program under the provisions of Chapter 2.9A a.€ Title 6 of_ Part 2 of the Penal Code are to be borne, and are bar.ne, by the fees generated Pram the operation of such program and from the utilization of existing staff, the funds far such program are available within the meaning of Section 1001.60 of the Penal Cade; BE TT FLiRTHER RESOLVED that , to the extent the r.asts of same are to be borne, and are borne, solely by the Fees generated Pram the operation of the District Attorney's Bad Check Alternative Prosecution Program, the IliStrict Attorney may contract with Computer Support Services of Citrus Heights, California for an is authorized to execute forthwith the lease agreement subject of the District Attorney's agenda request; BE IT FURTHER RESOLVED that the District Attorney may enter lnt0 an agreement With Pacific Educational 5ervir.es, Inc., of Auburn, California, and/or any other educational service provider of similar nature and qualification, to refer persons i.n the District Attorney's Bad Check Alternative Prosecution Program to the educational service provider for completion of the remedial class or r.lasses required by Chapter 2.9A of Title 6 of Part 2 of the Penal Code, with such persons paying any fees required by the educational service provider directly to such provider, and without any r_osts to the County of Butte; FINALLY, BE TT FURTHER RESOLVED that the District Attorney, through the Auditor-Controller, is authorized to set up a trust account for the receipt, depos~.t, and disbursement of funds received in restitution of bad checks issued or passed in the County and subject of the Bad Check Alternative Prosecution Pragr.am.
