WHEREAS, this Berard has received a petition from five or more
free-holders, requesting the abandonment of a public service
easement as described below, and at least one of the petitioners is
a resident of the township in which said public service easement is
situated; and
WHEREAS, pursuant to Chapter 3 of Part 3 of Division 9 of
California Streets and Highways Code, commencing with Section 8320,
this Board shall set a date, hour and place for a hearing on the
petition for abandonment.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors:
1. That this Board hereby gives notice that at its regular
meeting on January 26, 1993, at 10;45 a.m., in the Board Chambers,
Butte County Administration Building, 25 County Center Drive,
Oroville, California, a hearing shall be held to hear all persons
interested in the abandonment of that certain public service
easement located in Riehvale in the unincorporated area of the
County of Butte, State of California, lying between Lots 12 and 13
(AP 029-250-012, and 013}, of Thengvall Tract Unit One, and
RESOLUTION GIVING NOTICE OF HEARING ON PETITION
TO ABANDON A PUBLIC SERVICE EASEMENT
(PORTION OF 4 FOOT PUBLIC UTILITY EASEMENT,
THENGVALL TRACT UNIT ONE, RICHVALE}
described as follows:
Being that certain 4-foot wide Public Utility Easement
lying within Lats 12 and 13, as shown on the map of
Thengvall Tract Unit One, recorded in Book 30 Maps of
Record at Pages 11 through 13, County of Butte, State of
California, more particularly described as follows:
Being that certain 4-foot wide Public Utility Easement
lying 2-feet on each side of, parallel with and
contiguous to the lot line lying between said Lots 12 and
13 of the Thengvall Tract Unit One. Beginning at the
southeast corner of said Lot 12; thence N 00° 36' 00" E,
along said lot lien also the centerline of the easement,
113.25 feet to the northeast corner of said Lot 12 and
the end of the described line.
Excepting therefrom the portion of the 4-fact easement
lying within the 20-foot building setback line.
Also excepting therefrom that portion of the 4-foot
Public Utility Easement lying within the 12-foot Public
Utility Easement lying southerly of the northerly line of
said Lots 12 and 13.
2. That a map, showing the public service easement to be
abandoned is an file in the Office of the Butte County Department
of Public Works, 7 County Center Drive, Oroville, California 95965.
3. That at the conclusion of said hearing the Board intends
to abandon said public service easement.
4. That this abandonment proceeding is being conducted
pursuant to Chapter 3 of Part 3 of Division 9 of the California
Streets and Highways Code (commencing with Section 8320).
5. That this Resolution be posted and published pursuant to
the provisions of Chapter 3 of Part 3 of Division 9 of the
California Streets and Highways Code.
