OF NEAL ROAD SANITARY LANDFILL IN BUTTE COUNTY
W~IEREAS, the Neal Road Landfill Company (Contractor) and County of Butte
(County) entered into an agreement for operation and maintenance of the Neal Road
Sanitary Landfill on May 15, 1978; and
WHEREAS, existing law, the California Integrated Waste Management Act of
1989, requires County to divert 25% of solid waste from burial in the Neal Road
Sanitary Landfill by 1995, and SO% waste diversion by 2000; and
WHEREAS, in order to record waste quantities and waste diversion on the basis
of actual weight and to improve operational efficiency, Contractor has installed scales
at the landfill entrance; and
WHEREAS, present gate fees at the landfill are based upon approximate volume
of various types of vehicles; and
WHEREAS, the County compensates the State Board of Equalization's Solid
Waste Disposal Fee Account and the State Integrated Waste Management Board on
the basis of actual weight of solid wasted disposed; and
WHEREAS, it will be necessary to establish gate fees based upon actual weight,
in lieu of the present gate fees based upon approximate volume; and
WHEREAS, County and Contractor desire to establish revised gate fees based
upon actual weight which as close as practical approximates the avexage of present gate
fees and provides equivalent total revenue; and
WHEREAS, for a period of several months the Contractor has recorded the
actual weight of solid waste and associated gate fees for the various types of vehicles
entering the landfill; and
WHEREAS, based upon the information over said several month period, County
and Contractor have developed such a revised gate fee schedule, which is anticipated
to provide equivalent total revenue;
NOW, THEREFORE, BE IT RESOLVED by the Butte County Board of
Supervisors that the gate fees far the operation and maintenance of the Neal Road
Sanitary Landfill are established as set forth in Exhibit "A" attached hereto.
BE IT FURTHER RESOLVED that this resolution shall be effective on
February 1, 1993.
PASSED AND ADOPTED by the Board of Supervisors of the County of Butte,
State of California, this t5th day of December 1992 by the following vote:
