HomeMy WebLinkAbout929ORDINANCE NO.~ 9 AN ORDINANCE PERTAINING TO TRAII:ERR COACHEB AND CAMP BITES IN THE COUNTY OF BUTTE, STATE OF CALIFORNIA 1 2 The Board of Supervisors of the County of Butte, State of 3 California do ordain as follows: 4 That the following ordinance shall be placed in the Butte 5 County Code, Chapter 22, with the section numbers as shown herein: 6 Section 22-4: ry For the purpose of this Ordinance, certain words and phrases 8 are defined as follows: 9 ~a) "Trailer coach" means any camp car, trailer or other 10 vehicle, with or without motive power and designed for or used 11 for human habitation; 12 Cb) "Camp space" means any place temporarily maintained by 13 one or more persons for living or sleeping purposes; 14 (c) "Sheriff's office" shall include the sheriff of the 15 County of Butte, his duly authorized deputies; 16 Cd) "Health Officer" shall include the Health Officer of the 17 County of Butte, and all members of the Department of Health of 18 the County of Butte. 19 Section 22-5: l-•._._...__ _ __ 20 ~a) The Sheriff's office and/or Health Officer shall enforce 2I all the provisions of this Ordinance and shall inspect all accomo- 22 dations and installations the subj ect of this Ordinance. 23 Cb) The Health Officer is authorized to issue or deny writte 24 permits required by this Ordinance. 28 (c) Requests for permits shall be directed to the Health 26 Officer, who may require proof that applicant has the permission 27 of the owner or person legally in charge of the real property upon 28 which. a Pe rmit is requested. 29 (d) If the findings of the Health Officer are such that the 30 issuance of a permit would be detrimental to the health of any 31 person or adversely affect the sanitary conditions of the area, he 32 shall deny the application and not grant the permit. Permits T 6 7 8 9 10 11 12 13 i I4 15 16 17 18 19 20 21 22- 23 24 23 26 27 2S 29 30 31 32 shall not be transferrable and shall expire upon the date of ex- piration endorsed thereon. (e) The Health Officer shall, upon the issuance of any permit, forthwith transmit a copy thereof to the Sheriff's Office. Section 22-6: (a) No person shall park any trailer coach on public or private property within the County of Butte for a period in excess of five (5) days in any thirty (30) consecutive days without first having obtained a permit as herein provided, except in an approved trailer camp or labor camp. (b) No person shall occupy any camp space on public or private property in the County of Butte, for a period longer than five (5) days after notification in any thirty (30) consecutive days without first having obtained a permit as herein provided. Section 22-7: Any permit issued under the provisions of this Ordinance may be revoked for just cause by the Health Officer. Notice of re- vocation shall be made verbally to the valid holder of the permit and within 48 hours of service of notice an affidavit attesting to such service shall be filed with the County Clerk and be made of record. The permit shall be considered revoked within 5 days of such service. Section 22-8: The provisions of this Ordinance .shall not be construed to apply to any trailer coach or camp site referred to in an Act regulating Auto and Trailer Parks, Division XTTI, Part TT, Health and Safety Code, nor in an Act regulating camps where five or more persons are employed, Division TT, Part TX. Chapter T of .the Labor Code; nor shall this Ordinance be construed to apply to any super- vised public park or public camp or picnic ground operated and/or maintained by the Federal Government, the State of California, or any agency of said State nor by any political subdivision or 2. l 2 3 ' 4 5 6 7 8 9 10 11 12 13' Irk 15 16 17 18 19 20 21 22 23 24 28 26 27 28 29 30 31 32 municipalitya (a) The provisio ns of this Ordinance do not apply to any trailer coach parked in dead storage and not used for living or sleeping purposes. Section 22-9: Any person who violates any of the provisio ns of this Ordin- ance is guilty of a misdemeanor, punishable by a fine not exceed- ing Two Hundred Dollars ($200.00) or by imprisonment not exceeding 30 days or by both such fine and imprisonment. Section 22-10: The several features, parts, provisions, sections and terms of this Ordinance are hereby declared independent and severable and the invalidity, if any, of any featuz~, part, provision, sectio or term thereof shall not affect the remainder of this Ordinance nor render the same inoperative or invalid. All ordinances or ',parts or ordinances in conflict herewith are hereby repealed. ~ The foregoing Ordinance was duly passed and adopted by the Board of Supervisors of the County of Butte, State of California, at a regular meeting of said board held on the 23 day of May 1967, by the following vote: .AYES: Supervisors Dunaway,.
