HomeMy WebLinkAbout930ORDINANCE N0. 930 AN INTERIM ORDINANCE ESTABLISHING REGULATIONS FOR AN "A-3" (Agricultural} DISTRICT NITHiN A ~ PORTION OF THE UNINCORPORATED AREA OF BUTTE COUNTY 2 The Board of Supervisors of the County of Butte, State of Cali- fornia, does ordain as follows: 4' SECTION 1. NECESSITY. The Board of Supervisors finds that cer- tain regulations are necessary for the preservation of the public 5 health, safety, convenience and general welfare, pending the con- ducting of studies and surveys, and hereby adopts certain such 6' regulations as urgency measures of an interim nature as set forth below. 7, SECTION Z. The hereinbelow described area situate in the County', $' of Butte, State of California, shall be and it is hereby zoned as an "A-3" (Agricultural) District and such area shall be subject g: to the regulations and restricted uses hereinafter specified and provided, said area so zoned being located in the unincorporated 10 area of Butte County, State of California, and particularly de- scribed as follows: 11 As shown by map attached and as shaven on Butte County map in the office of Butte County Planning Commission and in the office 12 of Butte County Clerk. 13? 14 SECTION 3. The following regulations shall apply in an "A-3" 15 District: 16 3.1 Uses Permitted: 17' a. Single Family Dwellings. b. General farming, horticulture, commercial livestock, lg poultry productions, warehouse and storage. c. Accessory buildings and uses pertinent to the permitted 19: uses, including agricultural processing plants. d. Housing facilities (including trailers) to accommodate 20 only agricultural employees and their families employted by the owner or operator of the premises; and provided further that such 21 housing facility shall be considered accessory to the main build- ing, but shall conform to the provision pertaining to required 22 yard and open space for dwellings. 23, 3.2 The following uses subject to securing a use permit in each case: 2~k a. Golf courses and country clubs. 2g' b. Public or quasi-public uses including churches, fire- . houses, hospitals and clinics, parks and playgrounds, schools, 26 public utility buildings and professional buildings. 2'7' 3.3 Minimum Lot Area Required: Five (5) acres. 28 SECTION 4. The penalties for vio~~i;ions of the zoning hereby imposed upon said district shall be as provided in the said Zoning 29' Enabling Ordinance. 30 SECTION 5. This Ordinance shall be, and it is hereby declared to be in full force and effect from and after the date of its 3I• passage, pursuant to the emergency hereinafter found and declared; and it shall remain in full force and effect until such time as a 32 permanent ordinance covering the above-described area shall take effect, following notice, public hearings and such 1 2 3 4 5. 6 7 8 9 10 11 12 13 14 15 16 1'7 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 other procedure•s~ as are provided in said Zoning Enabling Ordinance, or until such time as the Board of Supervisors'shall determine 'that the area shall not be zoned as an "A-3" District. SECTION 6. For the immediate preservation of the public peace, health and safety of the area hereinabove described, and the resi- dents and inhabitants thereof, it is necessary that this ordinance 'take effect immediately. A declaration of the facts constituting :the necessity therefor is as follows: The adoption of such Interim Zoning Plan is necessary in the ;public interest, to maintain the status quo in such district pend- ing the determination of the application for such permanent detail zoning. SECTION 7. This emergency ordinance sha11 take effect immed- iately upon its passage; and before the expiration of fifteen (15) -days after its passage shall be published once with the names of all members voting for and against the same in the Chico- EnCerprise , a newspaper published in said County of Butte. PASSED and ADOPTED by the Board of Supervisors of the County of Butte, State of California, this 6th day of June 1967, by the following vote: RYES: supervisors Dunaway, Maxon, McKi.I7.op, Pryde and Chairman Howsden NOES: None ABSENT: None NOT VOTING: None ARL L.
