RESOLUTION ACCEPTING AND CERTIFYING THE
ENVIRONMENTAL IMPACT REPORT {EIR) ADOPTING A MITIGATION
MONITORING PROGRAM, AND DIRECTING THE FILING OF A NOTICE OF
DETERMINATION FOR THE RICHARDSON SPRINGS WASTEWATER IMPROVEMENT
PROJECT
WHEREAS, the Butte County Board of Supervisors has reviewed and considered the Final Environmental
Impact Report and Mitigation Monitoring Program for the proposed Richardson Springs Wastewater Impvoement
Project; and
WHEREAS, the issues were heard by the Board on January 26, 1993:
NOW, THEREFORE, BE IT RESOLVED, by the Board that it accepts, and hereby certifies, that the
information, contained in the Final Environmental Impact Report, in connection with the proposed project, has
been completed in compliance with the California Environmental Quality Act of 1970 {California Public Resources
Code 5ectian 21.000, et seq.} as amended, and the State guidelines thereto (California Administrative Code, Suction
15000, et seq.} and said report has been reviewed and considered by the Board; and
WHEREAS, pursuant to California Public Resources Code Section 21D81.6, the Board hereby adopts the
Mitigation Monitoring Program including Mitigation Measure #10 and labeled "Exhibit A," a copy of which is
attached hereto and incorporated herein by reference; and
WHEREAS, the Board will proceed with the filing of a Notice of Determination in compliance with Section
21108 or 21152 of the Public Resources Code.
BE IT FURTHER RESOLVED, that after considering the Final EIR and other information in the public
record, the Butte County Board of Supervisors approves the proposed wastewater improvement project and, with
incorporation of the mitigation measures presented in the Final EIR, finds that the project wilt not have a
significant effect on the environment.

Oroville, California by the following vote:

MITIGATION MONITORING REPORT
ISSUE: Water quality
IMPACTS}: High rates of infiltration, insufficient capacity of
existing ponds to store a I00-year rainfall and effluent.
Soils in the spray field have not been tested for suitability
to handle nitrogen and organic loading.
MITIGATION MEASURER:
1. Measurement of flow rates shall be made in segmented
portions, by qualified personnel, at the source of the
ma.an sewer line, and at both the upper pond and at the
lower pond to determine any fluctuations. These
measurements should be performed seasonally and at times
of peak usage.
2. a. The spray irrigated area shall be regularly monitored
for the amount of nitrogen in the percolate for a
period to be established by the CVRWQCB.
b. Additional acreage shall be added to the system, with
appropriate piping, pump station, storage, and low-
level spray system, if nitrogenz loadings or water
effluent volumes prove to be too great.

ISSUE: Water
IMPACT(S): The proposed 12-acre-foot storage pond zn.ay cause
impacts from the cut and fill for the berms, especially the
south side berm. Erasion from the berms may lead to
' sedimentation of Mud Creek.
MITIGATION MEASURE ~3, Perineter berms shall be covered with a
mulch and/ox planted with appropriate vegetation to hold the
soil in place. Exposed areas of berms not properly planted or
mulched by the onset of the rainy season (October 15) shall be
securely covered with appropriate material to protect the soil
fro~u the elements .

ISSUE: Geologic stability
IMPACT{S}: There may be secondary impacts from an earthquake as a
result of groundshaking. Wastewater from the oxidation ponds
' and/or the storage pond may spi11 over and flow into Mud Creek.
MITIGATION MEASURE ~4. The existing a~.dation ponds shall be
' reconstructed and the near storage pond shall be constructed to
meet Cal~.fornia state health and safety standards.

ISSUE: Soils
IMPACT{S}: Areas with less than 1$ inches of soil over the hardpan
layer may not adequately treat wastewater and may allow
partially treated wastewater to follow the hardpan layer down to
the road. The hardpan layer could allow partially treated
effluents to surface near the roadway. Cattle trails leading
downward across the spray field could collect and drain
wastewater on the surface toward the roadway.
MITIGATION MEASURE ~5. The spray field shall meet the requirements
of the Central Valley Regional Water Quality Control Board, and:
a_ The limits of the spray field shall be established on, the
basis of an adequate depth of soil as established by staff
of the Regional Water Quality Control Board.
b. All cattle trails and any minor drainageways leading
' downslope within the spray field area shall be graded out
and revegetated to avoid concentrat.ians and short-circuit
flows of effluents.
c. A collection ditch shall be constructed at the bottom of the
spray field that penetrates into the hardpan layer to
iza,tercept any surplus surface flows or flows on tap of the
hardpan .
d. Effluents shall be metered onto the spray field at a rate to
be deter~.i,ned in consultation with the Regional Water
Quality Control Board.

ISSUE: Fish and wildlife
IMPACT(S): The riparian area adjacent to Mud Creek could be impacted
by further development. The existing holding ponds are adjacent
to the creek and could adversely affect water quality in the
creek if any of the pond emban]~ents were breached.
MITIGATION MEASURE fib. A Z00-foot no-disturbance buffer area should
be established for Mud and Maple Creeks. No new construction or
equipment should be placed in. this area. The existing ponds and
outlet structures in this area may be retained, deepened and
lined to meet current State requirements.

ISSUE: Cultural resources
IMPACT(S): Several prehistoric and historic sites may be impacted.
MITIGATION MEASURES:
7. Buffer zones of at least 50 feet shall be maintained between the
archaeological sates and the proposed storage pond.
8. Any future consideration of expansion of the spray irrigation
area, or consideration of alternatives to the proposed project,
shall be preceded by an archaeological reconnaissance to avoid
impacting any prehistoric and historic sites.
~. Prehistoric/historic site CA-BiIT-51~ shall be avoided during
construction activities of the storage pond and shall not be
used as a staging area for construction equipment..

ISSUE:
Liability far wastewater treatment plant construction and
maintenance.
IMPACT(S):
Economic.
MITIGATION MEASURE #10:
Youth With a Mission shall be required to dissolve County
Service Area 130 and form a community Services District, or
equivalent governmental entity, which will accept fully the
responsibility and liability for the Richardson Springs Wastewater
Treatment Project development and maintenance, instead of and in
place of the County and/or CSA 130. The State of California and/or
its agencies must accept and approve the shift of liability from
the County/CSA 130 to the CSD or equivalent governmental entity.
Both of the above must occur prior to approval of the project.
