HomeMy WebLinkAbout93-015.~ 1Zeso7ution No. 93-L5 ESOLUTION REQUIRING CREATION OF A COMMUNITY SERVICE DISTRICT OR OTHER ENTITY TO ASSUME LIABILITY FROM COUNTY OF BUTTE FOR WASTEWATER TREATMENT PLANT CONSTRUCTION AND MAINTENANCE RESULTANT FROM PROJECT CONSTRUCTED BY FUNDS SECURED BY SMALL COMMUNITY GRANT NO. 250 UNDER THE CALIFORNIA CLEAN WATER BOND LAW OF 1988 WHEREAS, the Public Works Director is authorized to execute, for and on behalf of the County of Butte, an application for Small. Community Grant No. 250 under the California Clean Water Band Law of 1988 and any agreements or other documents necessary to secure and receive a state grant under said bond law; WHEREAS, the Public Works Director is authorized to execute the resultant grant agreement and any amendments thereto for the purpose of securing grant funds; WHEREAS, it is the County~s intent that a Community Service District or other public entity be created as soon as is practicable for the purpose of assuming liability far the Wastewater Treatment Plant Construction Project and maintenance of the plant; WHEREAS, it is the further intent of the County that the state remove any liability far the Wastewater Treatment Plant Construction and Maintenance from the County and/ar CSA 130 and, instead, place said liability fully with the newly created entity; BE TT RESOLVED, THEREFORE: (~.) that Youth with a Mission shall be required to dissolve County Service Area 130 and form a 1 5 Community Services District, or equivalent governmental entity, as soon as practicable, which will. accept fully the responsibility and liability for the Richardson Springs Wastewater Project development and maintenance, instead of and in place of the County of Butte and/or CSA 130; and that (2} the State of California and/or its agencies must accept and approve the shift of liability from the County/CSA 130 to the Community Service District or equivalent governmental entity. Bath of the above conditions (1) and (2} must occur prior to approval of the project. If either Conditions 1 or 2 do not occur prior to the approval of the project, the County of Butte reserves the right to cancel and withdraw the grant application and request.
