SLTPP-5912 RE:RECONSTRUCT TWO-LANE ROADWAY -WIDEN AND GRADE, ON GARNER LANE (0.8 MILE SOUTH OF KEEPER ROAD} PROJECT NO. SB93-5912(015} BE TT RESOLVED by the Board of Supervisors of the County of Butte, State of California, as follows: 1. That said County approve Program Supplement No. 013 to State- Loca1 Transportation Partnership Program Agreement No. SLTPP-5912 for State Share Funds for eligible projects in Butte County and Chair of the Board be authorized to execute said supplement on behalf of said County. Supplement No. 013 covers funding For eligible costs for the project to reconstnzct two-lane roadway -widen and grade, on Garner Lane (0.8 mile South to 1.0 mile South of Keefer Road, Project No. SB93-5912(015}. 2. That the Clerk of this Board be authorized to attach certified copy of this Resolution to Program Supplement No. 015. SLTPP-5912 This Program Supplement is hereby incorporated into the state-Local Trans- portation Partnership Program Agreement far State Share Funds which was entered into between the Local Entity and the State on 01/10/91 and is subject to all the terms and conditions thereof. This Program Supplement is adopted in accordance with Faragraph 3 of Article 2 of the aforemen- tioned Master Agreement under authority of Resolution Na. 93-33 approved by the Local Entity on March 23, 199~See copy attached) . The Local Entity further stipulates that as a condition to payment of funds obligated to this project, it accepts and will comply with any covenants or remarks setforth on the following pages. It is mutually understood between the parties that this contract may have been written before ascertaining the availability of legislative appropriation of funds, for the mutual benefit of both parties, in order to avoid program and fiscal delays that would occur if the agreement were executed after that determination was made. The total amount of State-Local Transportation Partnership funds payable by the State shall not exceed $42966 to be encumbered and reimbursed as follows. FY 92-93 $ 42966 FY 93-94 0 FY 94-95 0 Any increase in State Partnership funds will require a revised program supplement. Any decrease in State Partnership funds will require a revised finance letter. 2. The State Funds Share is calculated based on the lower of the approved eligible application amount or the eligible award amount. 3. Within 120 days of project completion a Final Report of Expenditures must be transmitted to the Caltran's District Local Streets and Roads Engineer. 4. A Final Audit must be completed and transmitted to the Caltran's District Local Streets and Roads Engineer by December 30th (the state fiscal year following project completion). 5. The Reimbursement Ratio for this Cycle 3 {92/93) project is 21.57. 6. In accordance with the State and Local Transportation Partnership Program Guidelines. dated April 1992, Section IV, Project Eligibility, the 10% allowance for construction engineering and contingencies is not eligible after Cycle 2. Only state/agency furnished materials can be added to the contract item cost for State Partnership funds eligibility. .,,. Page 2 of 2
