HomeMy WebLinkAbout93-037~eso~ution N~ RESOLUTION GIVING NOTICE OF HEARING ON PETITION TO ABANDON A PUBLIC SERVICE EASEMENT {PUBLIC UTILITY OVERHANG EASEMENT ON PORTION OF LOT 76 OF PARADISE PINES UNIT 5} WHEREAS, this Board has received a petition from five or more free-holders, requesting the abandonment of a public service easement as described below, and at least one of the petitioners is a resident of the township in which said public service easement is situated; and WHEREAS, pursuant to Chapter 3 of Part 3 of Division 9 of California Streets and Highways Code, commencing with Section 8320, this Board shall set a date, hour and place for a hearing on the petition for abandonment. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors: 1. That this Board hereby gives notice that at its regular meeting on May 11, 1993 at 10:00 a-::m,_ : , in the Board Chambers, Butte County Administration Building, 25 County Center Drive, Oroville, California, a hearing shall be held to hear all persons interested in the abandonment of that certain public service easement located in the unincorporated area of the County of Butte, State of California, identified as a Public Utility Overhang Easement, on a portion of Lot 76, of Paradise Pines Unit No. 5, and mare particularly described as follows: Being that certain Public Utility Overhang Easement lying within a portion of Section 23, T23N, R3E, M.D.M. as shown on the map of Paradise Pines Unit No. 5 recorded in Book 35 Maps of Record at pages 88 to 91, County of 1 Butte, State of California, more particularly described as follows: Beginning at the Northeasterly lot corner of Lot 76 of said subdivision; thence N 63 degrees 37' 33", 24 feet more or less to a point, said point being the point of intersection of the easterly lot line of Lot 69 with the northerly lot line of said Lot 76; thence from said point of intersection in a southeasterly direction 63 feet more or less to the southeasterly lot line of said Lot 76; thence N 24 degrees 47' 59" E, 55 feet more or less to the point of beginning. 2. That a map, showing the public service easement to be abandoned is on file in the Office of the Butte County Department of Public Works, 7 County Center Drive, Oroville, California 95965. 3. That at the conclusion of said hearing the Board intends to abandon said public service easement. 4. That this abandonment proceeding is being conducted pursuant to Chapter 3 of Part 3 of Division 9 of the California Streets and Highways Code (commencing with Section 8320}. 5. That this Resolution be posted and published pursuant to the provisions of Chapter 3 of Part 3 of Division 9 of the California Streets and Highways Code.
