HomeMy WebLinkAbout93-047RESOLUTION DECLARING PERSONS SENTENCED TO BIITTE COIINTY JAIL NOT ELIGIBLE FOR GENERAL ASSISTANCE BENEFITS WHEREAS, the County of Butte, the Butte County Sheriff's Department and the Butte County Jail are subject to a consent decree restricting the number of inmates confined in the Butte County Jail at any one time; and WHEREAS, in order to effectuate the jail population requirements of the consent decree, it is necessary to release persons committed to the Butte County Jaii to participate in a work release program known as the Sheriff's Work Alternative Program (SWAP) as authorized by Penal Code 4042.2; and WHEREAS, participation in the work release in the SWAP program is voluntary on the part of persons committed to the Butte County Jail in that said persons may refuse to participate and, instead, complete their term of commitment as an inmate in the jail ; and WHEREAS, persons who are committed to the Butte County Jail are not eligible for either Medical benefits or benefits under the County Medical Services Program (CSMP); and WHEREAS, the Butte County Welfare Department has reported to the Board of Supervisors that jail inmates released on the SWAP program have been reporting to the Welfare Department and applying for general assistance benefits under Welfare and institutions Code 17000; NOW, THEREFORE, it is hereby resolved that persons incarcerated in the Butte County Jail and convicted and sentenced to the Butte County Jail shall not be eligible for general assistance benefits. -2- The Butte County General Assistance Manual shall be amended and a regulation shall be added in the form attached hereto as Exhibit A. APPLICANT'S AND RECIPIENTS RESPONSIBILITIES 19 to keep for the purpose of determining the cause (good cause} for non-compliance with program requirements and referral to Services for appropriate assistance. (The Worker's determination is subject to review by the immediate Supervisor and by higher levels of supervision as deemed necessary). At the time of the scheduled appointment to review the proposed sanction, a good cause determination will be made and the applicant/recipient of General Assistance shall be informed of his/her right to a fair hearing. ARTICLE Z0. HOME VISITS A. A home visit shall be made during the exploration of eligibility and prior to granting an aid payment. B. In documented emergency situations, the Director may authorize an aid payment pending the home visit. ARTICLE 11. CONDITIONS OF ELIGIBILITY Sn order to be potentially eligible, the applicant/recipient: 1. Must be at least 2$ years of age or a legally emancipated minor. 2. Must not be enrolled in an institution of higher education if they are physically and mentally fit and considered employable. a. Exception to the above exists when the person is disabled or socially unemployable, (i.e., unable to speak English}. Such person(s) is referred to social services for assessments and to establish an appropriate County service plan. 3. Must not be.eligible far any other cash program or sanctioned by a cash program. i w w 4. Must not have quit a job in the month of application. 5. Must not be an inmate of the Butte County Jail who is released on a work release program pursuant to Penal Code X024.2. II. GENERAL ASSISTANCE NEEDS STANDARDS A. GENERAL ASSISTANCE MONTHLY ALLOWANCES to meet basic needs are subject to maximum amounts for items of need and shall be allowed at actual cost, but not to exceed statute maximums listed in Section B below. 9 1. Items of need shared with others shall be prorated by the number of persons sharing that item of need. 2. Items of need being provided by others shall not be allowed in the General Assistance grant. 3. Persons having shelter, utilities and food provided by others shall not be eligible for General Assistance. B. Authority is granted to the Welfare Director to grant to any persons) General Assistance funds not to exceed one hundred and fifty dollars ($1.50) in substantiated emergency situations. VI. DEFINITION OF A HOUSEHOLD Two or more applicants far General Assistance occupying the same residence and sharing housing costs and utilities shall be considered one household. The budget would be computed on the basis of the comparable budget unit with a prorated share of grant going to each individual. Each individual's separate income would be applied against his prorated share of grant. If applicant/recipient is sharing utilities with persons not considered in determining his/her needs, such persons are not considered a resource. A partial share or free utilities may be available because others in the home can meet this expense. The allowance for utilities covers the cost of electricity, water, fuel for cooking and heating, garbage disposal service, and sewer charge. VII. APPLICANT'S AND RECIPIENT'S RESPONSIBILITIES A. WHO MAY APPLY Any person array make application for General Assistance on behalf of himself, ward, or an assistance household. If the head of the household is available, he must initiate the application request and carry through by signing the application. B. APPLICANT'S AND RECIPIENT'S RESPONSIBILITIES The exploration of facts concerning eligibility shall be a joint responsibility of the applicant and the Department's Welfare Worker. The records or documents in the applicant's possession shall be used whenever possible to obtain information. 19
