WHEREAS, private individuals, Lea and Peter Steidlmayer, have petitioned the Butte County Planning Commission and Board of Supervisors, through an appropriate application, to amend. the Butte County General Plan. Land Use Element, far a change from Timber M~>untain to Timber Mountain with a Recreational Development Overlay far that property identified an Exhibit A-1 attached hereto; and WHEREAS, a public entity, Durham Unified School District, has petitioned the Butte County Planning Commission and Board of Supervisors, through an appropriate application to amend the Butte County General Plan Land Use Element, for a change from Agricultural Residential to Public far that property identified an Exhibit B-I attached hereto; and WHEREAS, the proposed General Plan Amendment far Leo and Peter Steidlmayer and Durham Unified Scht>ol District have been studied and reviewed by the Butte County Planning Commission and a public hearing held pursuant to law, at which time all interested persons were heard; and WHEREAS, the Butte County Board of Supervisors has reviewed and considered the contents of the environmental review study checklist far Leo & Peter Steidlmayer {Exhibit A-2) and far the Durham Unified Schaal District {Exhibit B-2) prepared on the amendment pursuant to the California Environmental Quality Act; and WHEREAS, the Butte County Board of Supervisors finds that the proposed General Plan Amendments and subsequent development for Leo and Peter Steidlmayer and the Durham Unified School District could not have a significant impact on the environment, but will not in this case because of the mitigation measures attached to the project and described on Exhibit A-3 and B-3 attached hereto; and WHEREAS, the Butte County Board of Supervisors has held hearings on the General Plan Amendments at which all interested parties were heard; and WHEREAS, the Recreational Development Overlay for the Leo and Peter Steidlmayer General Plan Amendment requires the adoption of additional policy statements contained in Exhibit A-4 attached hereto; and WHEREAS, the Butte County Beard of Supervisors finds the proposed amendments and policies as shown on Exhibits A-1, A-4, and B-1 comply with all elements of the Butte County General Plan and comprise an overall internally consistent whole, specifically: 1. The amendments comply with the policies of the Butte County General Plan, 2. The amendments provide for compatible development with existing land uses. NC~W, THEREFORE, BE IT RESOLVED as followsa 1. The General Plan Amendment to Commercial as shown on the attached Exhibit: A-1 and A-~, Leo b~ Peter Steidlmayer to Timber Mountain with Recreational Development t7verlay, B-1, Durham Unified School District to Public, are hereby incorporated by reference. 2. The General Plan Amendment is hereby adopted and by the Board of Supervisors of the County of Butte as amendments to the Butte County General Plan Land Use Element, said Amendments to be the land use policy for the County of Butte in the affected area for all findings pursuant to law. BE IT FURTHER RESOLVED, that the Board of Supervisors finds that the initial study and Negative declaration with mitigation measures prepared for the General Plan Amendment, identified as Exhibit A-2 for Leo and Peter Steidlmayer and B-2 for the Durham Unified School District are adequate for these projects for compliance with the California Environmental Quality Act. BE IT FURTHER RESOLVED, that pursuant to Government Code Section b5359 that the General Plan be endorsed to show that the above amendments have been approved by this Boards PASSED AND ADOPTED by the Butte County Board of Supervisors on this 13th day of Aprii 193, by the following vote, AWES: Supervisors Meyer, Dolan, Thomas and Chair Houx NOES: None ABSENT: Supervisor McLaughlin ABSTAINED: None MARY ANNE HOUR, CHAIRMAN Butte County Board of Supervisors ATTEST: John S. The Recreational Development Overlay is appropriate when the following criteria and policies are used: 1. The site was developed through the use of leases prior to County zoning for the site and local Subdivision Map act review. 2. As much as feasible, it shall be a policy to maintain the character of the area as seasonal recreational cabins, 3. The lots shall be created through a PUD zoning and associated subdivision. The initial phase of construction will consist of a school to accommodate approximately 32S students, 16 teachers and 8 support staff. The school will include a library, multi-purpose roam, administrative office and 14 classrooms. Please see Attachment B for a site plan. 5. ENVIRONMENTAL SETTING: Physical Environment 1. Terrain The site is level with a very slight southwest trending. It is approximately 168 feet above sea level with no limiting factors. 2. Sails r _. _..._. The surface soils consist of brown sandy silty clay to depths of 4 to 12 feet. The sail is permeable and has good drainage characteristics. 3. Natural Hazards The property is within a moderate earthquake intensity zone VIII. There are no concerns with regard to erosion potential, landslide potential, fire hazard or expansive soil potential. _ , 4. Hydrology There is no surface water on site. The site would be supplied by water by the existing well and storage tank. Annual rainfall in a normal year is 24 to 26 inches. 5. The visual and scenic quality is good. 6. The acoustic quality is good. 7. While the air quality is generally good, Butte County has been classified as anon-attainment area for particulate matter, 10 microns in size of less, ozone, and the Chico Urban Area for carbon monoxide. This means that Butte County exceeds either the California State or Federal ambient air quality standards. The EPA has classified Butte County as a "moderate" air pollution area. Biological Environment $. Vegetation The majority of the property is used as a school farm by Durham High School. It is used for various field crops and has a small almond orchard located on it as well. Two and one-half acres are currently residential and have a variety of shrubs and trees located on that portion. 9. Wildlife Habitat No endangered wildlife is expected to occur on the site. Small wildlife expected in an orchard and urban fringe area may occur. 10. Archeological and Historical Resources There are no known archaeologically sensitive areas on the site. 11. Existing Zoning The existing zoning on the majority of the property is PQ. Two parcels totaling about 2 112 acres are zoned SR-1, for which the district has applied for a General Plan Amendment and a Rezone. 12. Existing Land-Use on-Site The majority of the existing land use is for a school farm. The 2 112 acre balance is composed of two lots with a total of three residences on them. The entire site is currently owned by the school district. 13. Surrounding Area The property adjoins an almond ranch to the north and public facilities (Durham Unified School District and Durham Park and Recreation District) to the south and west. To the east across the Midway is an almond ranch. The majority of the surrounding land is zoned A-5. The parcel sizes range from 1 to 20 acres. The population designation is suburban fringe. 14. Public agencies are Free to devise thei.~- own format for initial stuaies.) DISCUSSION 4F ENVIRQNI~~IENTAL CHECICl.IST EVALUATION 1. Earth a. The project will be constructed on essentially flat land and will not involve any significant excavation, earth movement or cut and fill aperatians. b. The project .will involve compaction and covering of the soil on the portion of the site area on which the school buildings, parking area and blacktopped play areas will be constructed. Most of the site will remain open as grass play areas. The primary impact associated with the covering and compaction of the soil is related to flood control and is discussed in Item 3.a below. c,d. A review of Chico U.S.G.S. Quadrangle Map, the Geotechnical Investigation conducted by LRA Engineering and field observation indicate that the site is essentially flat with no unique topographic, geologic or physical features. e. The .majority of the site is currently utilized as a school farm. Development of the site as an intermediate school will likely decrease any soil or wind erosion due to the soil being held in place by grass, paved areas and building foundations. f. The site is not near any natural waterway, lake, bay or ocean. Butte Creek is approximately .5 miles to the east and will not be impacted. g. The site does not lie within a Special Studies Zone as defined by the State Geologist. There is no evidence to indicate any likelihood for shallow ground rupture due to faulting. Durham is located in a region that has had relatively low seismic activity and has been considered to have a low potential for earthquake hazards. Liquefaction potential for the subject site, based on the relative density using the number of blow counts, is expected to be low should strong seismic shaking occur (Geotechnical Investigation Report, LRA Engineering, 1992, and Geohazard Environmental Investigation Report, LRA Engineering, 1992). y 2. Air a. The project will not have a Long term substantial negative impact on air emissions or ambient air quality. Air pollution emissions associated with the project would come from traffic generated by the school and from the construction process (construction equipment and blowing dust). The vehicular trips (Item 13) generated by the school will not result in a significant incremental addition to air pollution emissions. The school is being developed to serve students who will live in this growing area. These students would have to attend existing schools within the District if this school is not developed. The project, therefore, will not increase the number and length of school-related trips and the need for bussing. The construction impacts are considered to be temporary. Dust control measures which are consistent with climatological requirements will be used. Dust can be cantroIled by sprinklering or other dust suppressants as necessary, Staff will monitor large off-road diesel equipment used for grading at the site to verify that it is maintained in goad operating condition in order to minimize diesel emissions. (See Mitigations, Attachment C.} b. Objectionable odors are not expected to be generated by the operation of an intermediate school. c. The construction of an intermediate school is not likely to appreciably affect air movement, temperature or climate in the area. Most of the site will remain in open space as play fields. 3. Water a. There is no surface water on or in the immediate vicinity of the project site. b. Coverage of a portion of the site with impervious surfaces (buildings, parking area, blacktop) will increase the amount of storm runoff as compared to some of the undeveloped site, but not to a degree that cannot be accommodated by planned leaching trenches approved by the Butte County Health Department. (See Mitigations, Attachment C.} c. The site is not listed on FEMA (Federal Emergency Management Agency} maps as a potential flood hazard area. y d,e. There is no surface water on or in the immediate vicinity of the project site which could be affected by the development of the school. f-h. The project will obtain water through the existing well and storage tank system utilized by the balance of the school district on the site. The school will install appropriate water conservation measures. i. Tidal waves are not a risk in the Durham area. 4. Plant Life a-c. The vegetation in the project area is thought not to be botanically significant or unique. Existing vegetation would be affected primarily by removal and replacement with ornamental landscaping and other improvements. d. A portion of the proposed construction site is currently used by the district periodically as a school farm for various field crops and an almond orchard. The majority of this would be replaced by turf play fields, The loss of agricultural land far this project is not significant. 5. Animal Life a-d. It is believed that the project will not have a significant impact on wildlife. There are no known rare ar endangered species which inhabit the project site. 6. Noise a. The playground, stationary equipment and traffic noises normally associated with a small intermediate school would be introduced in to the area. The temporary annoyances caused by some construction activities are not thought to be significant due to the fact that the area is not in the midst of a residential area. b. There are no noise sources in the site vicinity that will adversely affect educational operations at the school. 7. Light and Glare .a. The majority of the lighting will be security lighting in the building area and lighting? in the parking/loading areas. While lighting of the play fields is not proposed at this time, it may be added at a future date. However, the potential impact from that lighting would not be significant since there is only one residence in close proximity to the project site. $. Land Use a. The existing land use designation on the majority of the property is public with a zoning designation of public/quasi-public. Two lots, which compose a small corner of the project site, were recently purchased by the school district. These each have a single family residence on them and are zoned SR-l. The school district has filed an application for a general plan amendment and a rezone with the Butte County Planning Department. Planning staff has expressed support for the applied for change in Land use and zoning. {See Mitigation, Attachment C.} 9. Natural Resources a. Construction and operation of an intermediate school will use wood, metals, cement, sand and gravel, and energy resources, but not to an extent that would be considered to be unusual or unanticipated. 10. Risk of Upset a-b. The proposal will not involve a risk of explosion or hazardous materials. Schools are required to have evacuation plans in case of fire or other emergencies and to conduct regular emergency drills. 11. Population. The school is being built to accommodate students generated from the growth that is occurring in the general area. Given this current growth and the location of the school on the same property as existing schools, it is unlikely that the project will have any appreciable effect on the location, distribution, density or growth rate of the population of the area. 12. Housing Given that the school is being built in response to growth, it is unlikely that the project will cause a noticeable increase in demand for housing in the area. 13. Transportation/Circulation. a,c,d,f. At full capacity the intermediate school could generate about 170 vehicle trips per day on the Midway, based upon our estimates, including school buses. Much of this traffic would occur during non-peak hours mid- afternoon and after 8:00 AM. The District will agree to appropriate traffic mitigation measures such as curb, gutter, sidewalk and road wideninglstriping in front of the site as required by the Butte County Department of Public Works. These measures should mitigate concerns of the Durham Recreation and Park District. {See Mitigations, Attachment C.) b. Additional off-street parking at this site and loading facilities for school buses will need to be provided. The current plans call for about 50 parking spaces. {See Mitigations, Attachment C.} e. The project would not affect waterborne, rail or air traffic. 14. Public Services. a. Butte County Fire Department did not indicate that the proposed school would have any significant unavoidable adverse effects on their services. Fireflow, hydrant locations and access to buildings will be coordinated with that department. b. No response was received from the Butte County Sheriff's Office identifying significant adverse effects on law enforcement services. c. The proposed school will enhance school services in the area by relieving overcrowding at existing schools, and accommodating students from future growth in the community. d. The school will enhance recreational opportunities by providing additional useable open space and playfields. e. The new school facilities would be maintained by the District. The use and maintenance of some of the facilities and fields may also be addressed through a memorandum of understanding with the Durham Recreation and Park District. f. No responses by any agencies to which a request far comment was sent indicated that the project would adversely impact on any other governmental services. 15. Energy. a. The project would not use substantial or unanticipated amounts of fuel or energy. b. The project would not substantially increase the demand upon existing energy sources ar require the development of new energy sources. 16. Utilities. a. See energy above. b. The development and operation of an intermediate school would not appear to have any characteristics which would negatively impact communications. c. The district has its own permitted well on the existing site and a backup connection to the Durham Irrigation District water system, and the project is not anticipated to use unusual or unanticipated amounts of water. See section 3 above. d. The Durham area has no sewer system. Design and installation of the project's septic tank system will be reviewed and approved by the Butte County Health Department and the California State Regional Water Quality Control Board. {See Mitigations, Attachment G} e. The storm water runoff caused by the increase in impervious surfaces will be handled by leaching trenches approved by the Butte County Health Department. {See Mitigations, Attachment C.) f. Solid waste pickup anti disposal would be provided by a commercial company operating in the area. The project will not result in the need for new systems nor substantial alterations to the existing ones. I7. Human Health. a. The construction of an intermediate school, which is intended to provide a safe learning environment for children, is not expected to result in any health hazards. Food service facility plans will be reviewed and approved by the Butte County Health Department. b. A soils analysis of the project site has been conducted. There is no evidence that the project site is or has ever been a hazardous waste disposal site or solid waste site; that the site is or has been the site of a hazardous waste release; or that the site contains any underground or above ground pipelines which carry hazardous substances, acutely hazardous materials or hazardous wastes. Section 21151.3 of the California Health and Safety Code requires that no environmental impact report or negative declaration shall be approved for the construction of a school by a district unless the Iead agency has consulted with the County Air Pollution Control District where the school would be located to identify facilities within one-fourth mile of the proposed school site which might reasonably be anticipated to emit hazardous or acutely hazardous air emissions. The District has consulted with the Butte County Air Pollution Control District and received confirmation December 9, 1992, that no such facilities exist within one-quarter mile of the project site. {Gina Facca, Air Pollution Control Officer, discussion.) 18. Aesthetics There are no scenic vistas or views that would be obstructed by the construction of an intermediate school on the site. The school which will include substantial open space areas would not be considered to be a use that creates aesthetically offensive conditions. 19. Recreation. The project would .enhance recreation opportunities by providing additional open space and playfields to the area. The District has and will continue to consult with the Durham Recreation and Park District to coordinate the maintenance and use of recreational facilities. 20. Cultural Resources.
