,Resolution WHEREAS, SB509 has been adopted by the California Legislature, signed by the Governor, and chaptered as Chapter 73 of the Statutes of 1993; and WHEREAS, said legislation extends far six months (from July 1, 1993 through December 31, 1993) the state's existing temporary 1/2 cent sales and use tax; and WHEREAS, said legislation acknowledges that Senate Constitutional Amendment 1, placed on the November 2, 1993, special statewide election ballot, will, if approved by a majority of the voters voting on the issue, impose an "additional" one half cent sales and use tax on and after January 1, 1994, the effect of which would be to continue the sales and use tax at the current level; and WHEREAS, SB 509 also creates the Local Public Safety Fund and provides for revenues to be deposited therein from said 1/2 cent sales and use taxes; and WHEREAS, said legislation provides that monies in the Local Public Safety Fund may be appropriated only for "public safety services," and shall be allocated in each "qualified county"; and WHEREAS, the County of Butte wishes to be a "qualified county" as , defined in said legislation, and in particular in Government Code Section 30052{b}(2} enacted thereby, in order to qualify for allocation of revenue from the Local Public Safety Fund. 1 RESOLUTION REQUESTING ALLOCATION OF REVENUE FROM LOCAL PUBLIC SAFETY FUND AND RATIFYING IMPOSITION OF STATEWIDE ONE-HALF CENT SALES TAX NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of the County of Butte hereby requests an allocation of revenue from the Local Public Safety Fund and specifically from both accounts therein, namely the Interim Public Safety Account and the Public Safety Account. BE TT FURTHER RESOLVED, that the Board of Supervisors of the County of Butte ratifies the statewide imposition of an additional 1/2 o rate of sales and use tax pursuant to Senate Constitutional Amendment 1 on the November 2, 1993, Special Election Ballot. BE TT FURTHER RESOLVED, that the Board of Supervisors of the County of Butte directs creation of a Public Safety Augmentation Fund pursuant to Government Code Section 30054 to consist of all revenues to be received by the County as a result of allocations pursuant to Government Code Sections 30052 and 30053. The resalutlon is required by SB a09, and It must state two things: (1j that t#le county requests an allocation trorn the Local Public Safety Fund, and (2j that the county ratifies the statewide vote an SCA 1.
