POLICIES FOR PRE-APPLICATION FOR USE PERMITS AND VARIANCES
WHEREAS, by Resolution Nos. $5-112 and 90-12, the Board of Supervisors
had determined that development which resulted from the approval of Use Permits and
Variances must comply with the ordinances and regulations regarding land use, water
supply, sewage disposal systems, drainage, access roads, and any other infrastructure
requirements; and
WHEREAS, the Board of Supervisors by Resolution Nos. 85-112 and 90-12
adopted apre-application review process in order to assure compliance of Use Permits
and Variances with such ordinances and regulations, prior to the final consideration of
said Use Permits and Variances; and
WHEREAS, said pre-application review process has been determined by the
State of California, Governor's Office of Planning and Research to be inconsistent with the
Permit Streamlining Act if made mandatory; and
WHEREAS, the Board of Supervisors still desires to offer applicants a means
of determining if their proposed Use Permit and Variance projects can meet County
development ordinances and regulations;
NOW, THEREFORE, BE IT SO RESOLVED, that apre-development review
no longer be required for Use Permits and Variance applications being received by the
County.
BE IT FURTHER RESOLVED, that all Use Permit and Variance applicants
have the option of requesting apre-development conference for the purpose of gaining
information from County departments involved in the development process and interested
local and State agencies.
PASSED AND ADOPTED by the Butte County Board of Supervisors on the
28th day of septembex , 1993, by the following vote:
AYES: Supervisors Meyer, Dolan, McLaughlin, Thomas and Chair Houx
