$UPERVISORS DECLARING ITS INTENTION TO SEEK
AMENDMENT OF THE REDEVELOPMENT PLAN FOR THE
GREATER CHICO URBAN AREA REDEVELOPMENT
PROJECT AREA TO INCLUDE AN EARLIER ADOPTED
RESOLUTION CLARIFYING THE PLAN, SUBJECT TO
EXCEPTIONS
WHEREAS, by Ordinance No. 3102 adapted by the Butte County
Board of Supervisors on October 26, 1993, the Board of
Supervisors, as the legislative body of the County of Butte,
authorized the redevelopment of certain and specific pardons of
unincorporated land located in the Greater Chico Urban Area,
pursuant to Health and Safety Gode section 33213; and,
WHEREAS, such certain and specific portions of
unincorporated land are located within the lands described in the
Redevelopment Plan for the Greater Chico Urban Area Redevelopment
Project Area ("Plan"}; and,
WHEREAS, the redevelopment authorized by the County of Butte
upon those unincorporated lands will be undertaken pursuant to
the Plan; and,
WHEREAS, the County of Butte has approved said Plan; and,
WHEREAS, in authorizing the described redevelopment upon the
unincorporated lands and approving the enabling Plan, the Board
of Supervisors adopted Resolution No. 93162 on October 26, 1993
clarifying the intent and powers contained in the Plan; and,
WHEREAS, in adopting Resolution No. 93-162, the Board has
expressed its intent that said Resolution be incorporated into
the Plan, subject to certain exceptions.
NOW, THEREFORE, THE BOARD OF SUPERVISORS OF BUTTE COUNTY,
ACTING AS THE LEGISLATIVE BODY OF THE COUNTY OF BUTTE,
HEREBY DECLARES AND RESOLVES AS FOLLOWS:
1. The Board expresses its intent that the Chico City Council
and the Chico Redevelopment Agency takes steps necessary to
amend the Plan to include Resolution No. 93--162 as soon as
is practicable, but in no event earlier than January 15,
199"~, and then subject to the exceptions and conditions set
forth herein and further subject to any similar terms and
conditions which may be imposed by either the Chico City
Council or the Chico Redevelopment Agency.
2. Such exceptions and conditions are:
a. That such amendment comport with applicable procedures
set forth in the Community Redevelopment Law;
b, That such amendment not be undertaken whatsoever if to
da so;
1. would result in an adverse financial impact to the
County or would result in an articulable risk of
such adverse financial impact; or,
2. would result in an adverse impact upon the Plan
and/or upon the feasibility of completing the
Projects set forth in the Plan; or,
3. would result in a substantive change to the Plan;
ar,
4. would result in a substantive change to the Local
Agency Reimbursement Agreement negotiated between
the County and the Redevelopment Agency of the
City of Chico; or,
5. would otherwise not be in the best interest of the
County.
PASSED AND ADOPTED by the Board of Supervisors of the County of
Butte, State of California, on the 9t day of November f 1993, by
the following vote:
