HomeMy WebLinkAbout93-206h' esolufiort N0. 93--2Q6 WHEREAS, this matter came on regularly for hearing before the Board of Supervisors of the County of Butte, State of California, ~on December 14, 1993 , 1993, in the Board Chambers, Butte County Administration Building, Oroville, California; and, WHEREAS, it appearing to said Board that notice of the time and place of the hearing on the petition for the abandonment of the said easements in question was duly and regularly given as required by law; and, WHEREAS, testimony and evidence, bath oral and documentary, having been produced at said hearing, from which said Berard now finds that the hereinafter described easements are unnecessary far present or prospective public use. NOW, THEREFORE, IT IS HEREBY ORDERED as follows: 1. That the easements situated in the County of Butte, State of California, as hereinafter more particularly described, are hereby abandoned pursuant to Chapter 3 of Part 3 of Division 9 of the California Streets and Highways Code (commencing with Section 5320). 2. That said easements so abandoned are located in the unincorporated area of the County of Butte, State of California, are identified as light and air and public utility easements, are located in 1 RESOLUTION ABANDONING A LIGHT AND AIR EASEMENT AND PUBLIC UTILITY EASEMENT (PORTION OF LOT b0, CARRIAGE MANOR, OROVILLE AREA, AP 036-780-Ob0) the unincorporated area of the County of Butte, State of California, lying within the NE 1/4 of Section 28, T19N, R4E, being a portion of Lot 60 of Carriage Manor, identified as AP 036-780-060, Oroville, and are more particularly described as follows: Being that certain 5 foot, Light and Air Easement and Public Utility Easement lying within the Northeast one quarter of Section 28, T19N, R4E, also being a portion of Lot 60 of Carriage Manor, a planned unit development, recorded in Book 66 Maps of Record, at Pages 48 and 49, County of Butte, State of California; mare particularly described as follows: Being that certain 5 foot, Light and Air Easement and Public Utility Easement lying within, contiguous to and parallel with the Easterly iot line of said Lot 60, beginning at the Southeast lot corner of said Lot 60; thence North along said lot line 78.00 feet to the northeast lot corner of said Lot 60 and the end of the described easement. 3. That a map showing the easements hereby abandoned is on file in the office of Butte County Department of Public Works, 7 County Center Drive, Oroville, California 95965. 4. That the Clerk of this Board shall cause a certified copy of this Resolution, with the seal of the Board of Supervisors of the County of Butte, State of California, to be recorded in the office of the Recorder of the County of Butte, State of California.
