HomeMy WebLinkAbout93-210Resojufion 210. 93-210 WHEREAS, the County of Butte has constructed and maintained roadways commonly known as County Center Drive and Court Street, located within the Butte County Center and more particularly referenced in the Butte County Center map attached as exhibit A; WHEREAS, these specific roadways designated in exhibit A and referenced, hereafter, collectively as "roadways," though owned and maintained by the County of Butte, have not previously been formally declared and adopted as county highways; WHEREAS, these roadways lie wholly within the incorporated city limits of the City of Oroville; WHEREAS, the County Board of Supervisors desires to designate these roadways as county highways for the purposes of acquisition of rights of way, construction, maintenance, improvement or repair; and, for the purpose of adding the mileage of these roadways to the County's total mileage of maintained roads, thus rendering those roadways eligible for Highway Users Tax Fund certification, calculation and distribution in accordance with Section 2104 of the Streets and Highways Code; WHEREAS, Streets and Highways Code Section 1700 grants the Board of Supervisors authority to declare, by resolution upon RESOLIITION DECLARING COUNTY CENTER DRIVE AND COURT STREET AS COUNTY HIGHWAYS AND REQUEST FOR CONSENT FROM OROVTLLE CITY COUNCIL -~- approval by 4/5 vote of its members, that any highway in the county lying in whole or in part within a city to be a county highway. NOW, THEREFORE, BE IT RESOLVED: Pursuant to the authority of Streets and Highways Code section 1700, the Board of Supervisors does hereby declare, upon a positive 4/5 vote of its members, that the roadways described above are hereafter designated as county highways for the purposes of acquisition of rights of way, construction, maintenance, improvement, repair and for certification as part of Butte County's total mileage of maintained roads for purposes of Highway User's Tax Fund certification, calculation and distribution in accordance with Section 2104 of the Streets and Highways Code. NOW, THEREFORE, BE IT FURTHER RESOLVED: Pursuant to Streets and Highways Code section 1701, the Board of Supervisors formally requests that the Oraville City Council consent to this designation and declaration.
