IMPLEMENTATION OF LOCAL PLAN CONTINUING THE USE OF EXISTING
MEDICAL SYSTEM PROVIDERS AND PROVIDING FOR COMPETITIVE
BID PROCESS AT PERIODIC INTERVALS
WHEREAS, Health and Safety Code Section 1797.200 provides that
each county may develop an Emergency Medical System (EMS) program
and provides that each county developing such a program designate
a Local EMS Agency which shall be the County Health Department, or
other designated agency;
WHEREAS, the County of Butte has designated Nor-Cal EMS as
its local EMS Agency; provided, however, that issues relating and
regarding the establishment of exclusive operating areas, the
installation of operators within those areas and the implementation
of a competitive bid process are retained by the County of Butte;
WHEREAS, Health and Safety Code Section 1797.204 provides that
the local EMS Agency shall plan, implement, and evaluate an
Emergency Medical Services System consisting of an organized
pattern of readiness and response services based on public and
private agreements and operational procedures;
WHEREAS, the County of Butte and Nor-Cal EMS have prepared an
EMS Plan and have submitted the same to the State Emergency Medical
Systems Authority;

WHEREAS, Health and Safety Code Section 1797.224 provides
authority to the County, as the local EMS Agency in this context,
with the authority to create one or more exclusive operating areas
in the development of a Local Plan. This section further provides
that no competitive process is required if the County develops or
implements a Local Plan that continues the use of existing
providers operating within the County in the manner and scope in
which services have been provided without interruption since
January 1, 1981. Finally, this section requires that the plan
creating and establishing exclusive operating areas and installing
operators shall include provisions for a competitive process held
at periodic interviews;
WHEREAS, in June of 1992, in the development of a Local Plan,
the County Health Officer acted to formally establish exclusive
operating areas within the County and has further acted to install
the current operators within those exclusive operating areas;
WHEREAS, the County Health Officer further intended to
establish provisions for a competitive bid process to be held at
periodic intervals pursuant to Health and Safety Code Section
1797.224;
WHEREAS, the Board of Supervisors now seeks to approve these
actions, in conjunction with Nor-Cal EMS, pursuant to Health and
Safety Code Section 1797.85;
BE IT RESOLVED, THEREFORE, by the Board of Supervisors of the
County of Butte, that the following findings and determinations are
hereby made and established:

1. The findings and conclusions of the County Health Officer
set forth on June 2, 1992 and submitted to the State EMSA June 5,
1992, attached as Exhibit A, are hereby incorporated by reference
and adopted by the Board of Supervisors.
2. Based on these findings, and pursuant to the authority
granted to the County pursuant to Health and Safety Code Sections
1797.85, 1797.204, 1797.224, 1?97.250, 1797.252, and 1797.254, the
County of Butte hereby formally amends its Local EMS Plan by
directing the incorporation of Exhibit B of this resolution into
the EMS Plan, creating the exclusive operating zones set forth in
Exhibit A and establishing the current operators in those areas as
exclusive operators, subject to the following paragraph and the
provisions of Exhibit B.
3. The installation of the operators within the exclusive
operating areas is intended as an interim measure. Pursuant to
Health and Safety Code Section 1797.224, the County of Butte hereby
sets the following schedule providing for a competitive process for
each of the five zones:
