RESOLUTION FOR SUMMARY ABANDONMENT
OF OFFER OF DEDICATION OF DURHAM AVENUE FOR
A PUBLIC HIGHWAY WITHIN A.F. JONES
SUBDIVISION IN THE DURHAM AREA
WHEREAS, the Official Map of A.F. Jones Subdivision of the
Ferson Farm, recorded June 8, 1911, in Book 7, Page 53, of Maps,
contained an offer to dedicate Durham Avenue, a 60 foot wide right of
way to be used as a public highway, said offer being conditioned upon
the Northern Electric Railway re-locating its then-existing railway from
within said right of way to lot 32 of the subdivision; and,
WHEREAS, said railway right of way was never re-located, and
A.F. Jones deeded a portion of said lot 32 to the County of Butte for
public highway purposes, by deeds accepted on September 11, 1914, and
March 4, 1915; and
WHEREAS, the result of the acceptance of said deeds was to
relocate the contemplated public highway, from Durham Avenue to Jones
Avenue, to supersede the offer of dedication and to cause the right of
way contemplated in said offer to be no longer necessary or required
for public highway purposes; and
WHEREAS, vacation of said offer of dedication will not cut
off access to any person's property and will not terminate any public
service or utility easement; and
WHEREAS, pursuant to Government Code Section 66477.2 (c) and
Chapter 4 of Part 3 of Division 9 of the Streets and Highways Code,
commencing with section 8330, the Board finds that said offer of

NOW, THERE~....E, BE IT RESOLVED as folk. ~:
1. That the offer of dedication of Durham Avenue, a 60 foot
wide right of way to be used as a public highway, as specified in the
Official Map of A.F. Jones Subdivision of the Ferson Farm, recorded June
8, 1911, in Book 7, Page 53, of Maps, is hereby summarily vacated and
abandoned pursuant to Government Code Section 66477.2 (c) and Chapter 4
of Part 3 of Division 9 of the California Streets and Highways Code,
commencing with Section 8330.
2. That the Clerk of this Board shall cause a certified copy
of this Resolution, with the seal of the Board of Supervisors of the
County of Butte, State of California, to be recorded in the
office of the Recorder of the County of Butte, State of California.
3. That from and after the date that this resolution is
recorded, the offer of dedication of said public right-of-way hereby
vacated and abandoned shall no longer constitute an offer of dedication
of a right of way for a public highway.

this 22nd
