HomeMy WebLinkAbout94-031BOARD OF SUPERVISORS COUNTY OF BUTTE, STATE OF CALIFORNIA ~"lt'SO~Ul'10i1 ~~D, 94-31 RESOLUTION OF THE BUTTE COUNTY BOARD OF SUPERVISORS CERTIFYING CONFORMANCE WITH THE CLEAN AIR TRANSPORTATION IMPROVEMENT ACT (CATIA) FOR PROPOSITION 116 NON-URBAN COUNTY TRANSIT PROJECTS AND AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO SIGN PERTINENT DOCUMENTS WHEREAS, the County of Butte meets the statutory requirement to be eligible for CATIA Proposition 116 Non-Urban County Transit Project funding, pursuant to Section 99628 of the Clean Air and Transportation Improvement Act of 1990; and WHEREAS, the Gounty of Butte desires to purchase alternative fueled transit vehicles, construct Class 1 bike paths, install bus stop shelters and construct a transit turnout, and install Compressed Natural Gas (CNG) fueling facilities with CATIA funds; and WHEREAS, the allocation of Proposition 116 funds will impose certain obligations upon the County of Butte, including certifying documents prior to executing a Fund Transfer Agreement. NOW, THEREFORE BE IT RESOLVED as follows: by the Butte County Board of Supervisors, in conformance with the requirements of the California Transportation Commission and the Clean Air and Transportation Improvement Act (CATIA), hereby certifies: 1 The County of Butte maintains internal management controls in compliance with Federal Transit Administration (FTA) Guidelines for Grantees. 2. The County of Butte's invoicing (accounts payable and accounts receivable) and reporting procedures are consistent with the Office of the State Controller's "Uniform System of Accounts for Public Transit Operators". 3. The County of Butte complies with the contract and procurement procedures that are in are in accordance and comply with the significant aspects of FTA Circular 4220.1B, Third Party Contracting Guidelines". 4. New development fees, taxes, or permit fees have not and will not be included in the operating budgets for the listed projects. 5. Other funding sources will be utilized to complete this project if the project casts exceed those identified in the application. 6. The County of Butte has the financial and institutional ability to accept the legal liabilities associated with this project. 7. The County of Butte will take all reasonable steps to assure full due diligence in the discovery of hazardous wastes on or below acquired property's surface. 8. Additional state funds will not be sought for cleanup, damages, or liability costs associated with hazardous waste an or below acquired property's surface. 9. The Clean alr and Transpartatlon Improvement Act {CATIA} funds allocated will not supplant funds previously planned, programmed or approved for the purpose for which the CATIA funds were awarded. BE IT FURTHER RESOLVED by the Butte County Board of Supervisors that the Butte County Director of Public Works or authorized Deputy is hereby authorized and directed to sign all documents related to applications, contracts, and agreements pertinent to the Proposition 116 Non-Urban County Transit Program.
