HomeMy WebLinkAbout94-045;k~: ,, ., ~~:. ~ ;. :~a d ~, i~ ~ t°sc? t~ f i~~rl ~ ~ ~7 94-45 RESOLUTION FOR ANNEXATION TO COUNTY SERVICE AREA NO. iaa HOLLY GARDENS WHEREAS, pursuant to Title III, Division II, Part 2, Chapter 2.2 of the Government Code of the State of California, commencing with Section 25210.1, the County of Butte has petitioned the Local Agency Formation Commission ("LAFCO"} far the annexation of .58 acres to County Service Area No. 100 (Holly Gardens); and WHEREAS, on April 7, 1994, LAFCO adopted and passed a Resolution making determinations and approving the annexation to County Service Area No. 100; and WHEREAS, said Resolution adopted and passed by LAFCo authorized the Board to conduct proceedings for the annexation to County Service Area No. 100 without notice and hearing and the Board may proceed in such manner pursuant to Government Code Section 25210.4; and WHEREAS, pursuant to Government Code Section 25210.14 the Board of Supervisors {"Board") of the County of Butte may approve said annexation to the County Service Area without notice of hearing. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, as follows: 1. Said Board hereby finds and determines that the proceedings herein were conducted pursuant to Section 25210.1 et seq. of the Government Code. 2. The Board hereby determines to annex to said County Service Area No. 100 (Holly Gardens) without notice and hearing. 3. The boundaries of the annexation to said County Service Area is hereby finally determined and established to be the same as shown on Exhibit A attached hereto and incorporated herein and made a part hereof by this reference. 4. The name of said annexation is 94-32 -Annexation to County Service Area No. 100 -Holly Gardens. 5. The following types of services are hereby found to be extended county services and are to be provided within said area: Street lighting, storm drain and sewer pump station maintenance. 6. In accordance with the provisions of Government Code Section 25210.77a and Butte County Code Sections 21.85 through 21.90, aper-parcel service charge shall be levied against all the parcels within County Service Area No. 100. Each parcel shall be assessed an individual service charge based upon benefit. Said charge shall appear as a separate item on the tax bill and shall be collected at the same time and in the same manner as ordinary county ad valorem taxes are collected and shall be subject to the same penalties and the same procedure and sale in the case of delinquency as provided for such taxes. All laws applicable to the levy, collection and enforcement of county ad valorem taxes are collected and shall be subject to the same penalties and the same procedure and sale in the case of delinquency as provided for such taxes. All laws applicable to the levy, collection and enforcement of County ad valorem taxes shall be applicable to such charge, except that if real property to which such charge relates has been transferred or conveyed to a bona fide purchaser for value, or if a lien of a bona fide encumbrancer, for value has been created and attached thereon, prior to the date on which the first installment of said taxes would became delinquent, then the charge confirmed shall not result in a lien against said real property but instead shall be transferred to the unsecured roll for collection. 7. Said County Service Area is annexed for all purposes subject only to compliance with the requirements of Chapter 8 (commencing with Section 54900), Part I, Division II, Title V of the Government Code and subject to the provisions of Article 2.5 {commencing with Section 25210.21), Chapter 2.2, Part II, Division II, Title III of the Government Code of the State of California. Reed and Annelle M. Reed, husband and wife as community property, which deed was recorded November 6, 1991 in said recorders office at serial number 91-046449, and being more particularly described as follows; COMMENCING at the centerline-centerline intersection of West 11th Avenue and Holly Avenue as said location is shown on the Holly Gardens Subdivision Map, which map was recorded July 18, 1988 in said recorders office in Book 112 of Maps at pages 7 through 11; THENCE South 60'43'08" West a distance of 190.79 feet along the centerline of West 11th Avenue; THENCE at right angles to said centerline North 29'16'52" West a distance of 25.00 feet to the most southerly corner of the parcel described in the afore ~ ntioned Reed parcel; THENCE North 29'15'16" West a distance of 5.00 feet along the southwesterly line of said Reed parcel to the TRUE POINT OF BEGINNING far the herein described parcel; ~= THENCE continuing North 29'15'16" West a distance of 146.03 feet along said southwesterly line; THENCE North 60'42'37" East a distance of 158.21 feet along Reed's northwesterly boundary to the beginning of a 733.00 foot radius non-tangential curve to the left, the tangent to which bears South 31'11'03" East; THENCE southeasterly along the arc of said curve a distance of 83.79 feet through a central angle of 6'32'49" to a point on the northeasterly line of said Reed parcel; THENCE South 29'15'16" East a distance of 42.71 feet along said northeasterly line to the beginning of a 20.00 foot radius curve to the right; THENCE southeasterly, southerly and southwesterly along the arc of said curve a distance of 31.41 feet through a central angle of 89'58'24" to a point which lies 30.00 feet northwesterly of the centerline of West 11th Avenue; THENCE south 60'43'08" West a distance of 195.81 feet along a line which is parallel with and 30.00 feet northwesterly of said centerline to the TRUE POINT OF BEGINNING.
