HomeMy WebLinkAbout94-062Resolution RESOLUTION GIVING NOTICE OF HEARING ON PETITION TO ABANDON A PUBLIC RIGHT-OF-WAY (PORTION OF OPENSHAW ROAD) WHEREAS, this Board has received a petition tram ten or more free-holders, requesting the abandonment of a public right-of- way as described below, and at least one of the petitioners is a resident of the road district in which said right-of-way is situated; and WHEREAS, pursuant to Chapter 3 of Part 3 of Division 9 of the California Streets and Highways Cade, commencing with Section 8320, this Board sha11 set a date, hour and place for a hearing on the petition for abandonment. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors: 1. That this Board hereby gives notice that at its regular meeting an ~'uly 26, ].994 ~gg4 ~ at 10:15 a.m. , in the Board Chambers, Butte County Administration Building, 25 County Center Drive, oroville, California, a hearing shall be held to hear all persons interested in the abandonment of that certain right-of-way located in the unincorporated area of the County of Butte , State of California, identified as at the easterly end of Openshaw Road, northwest of the Highway 149, Highway 70 Intersection, central Butte County AP 41-200-01.9, 038, 41-160--050, and mare particularly described as follows: See Attached Exhib~.t 2. That a map showing the public right-of-way to be abandoned is on file in the Office of the Butte County Department of Public Works, 7 County Center Drive, Oroville, California 95965. 3. That at the conclusion of said hearing the Board intends to abandon said public right-of-way. 4. That this abandonment proceeding is being conducted pursuant to Chapter 3 of Part 3 of Division 9 of the California Streets and Highways Cade (commencing with Section 8320). 5. That this Resolution be posted and published pursuant to the provisions of Chapter 3 of Part 3 of Division 9 of the California Streets and Highways Code. Ranches to the State of California dated June 2, 1975 and filed far record in Baok 2026. Official Records at Page 10, all lying in Sections 15 and 16, Township 20 North, Range 3 East, M.D.M. Butte County, California, and being more particularly described as the fallowing two described parcels: PARCEL ONE: A strip of land, of varying width, lying bath to the right and to the left of the following described centerline, over a portion of Section 15 and 16, Township 20 North, Range 3 East, M.D.M. ,said centerline being more particularly described as follows: Commencing at the northwest comer of that certain parcel of land as described in deed to the Butte County Sheriff Mounted Posse, as filed for record in Official Records as Serial Number 92-02101, said corner being marked upon the ground by a one-half inch re-bar tagged L.S. 4085 as shown on that Record of Survey as filed for record in Book 124, Maps at Page 60: thence N 00°29'56" W, along the northerly pro~ectian of the west line of said parcel, 45.51 feet, to a paint on the centerline of Openshaw Road; thence S 62°00'17" E, along said centerline, 175.00#eet, to the TRUE POINT OF BEGINNING for the herein described centerline; thence S 62°00'17" E. 254.42 feet, to the beginning of a curve to the right, having a radius of 6'?0.00 feet and a central angle of 27°55'00": thence southeasterly along said curve, 316.70 feet; thence S 34°05'17" E, 961.52 feet, to a point an the east line of said Section 16; thence S 34°05'17" E, 218.4 feet, more or less, to a point an the souther{y boundary of said SEGMENT NUMBER 1, and the end of the described centerline. PARCEL TWO: . That certain parcel of land as described in deed from G. & M. Ranches to the State of California dated June 2, 1975 and filed for record in Book 2026.Official Records at Page 10, lying in Section 15, Township 20 North, Range 3 East, M.D.M. Butte County, California, RESERVING from the two above described parcels, any existing easements andlar rights at any time, or from time to time, to maintain, operate, replace, remove, renew and enlarge the existing public utility facilities and facilities incidental thereto, including access to protect the property from all hazards in, upon, aver the highway herewith abandoned.
