RESOLUTION ABANDONING A PUBLIC RIGHT-OF-WAY
(PORTION OF OPENSHAW ROAD)
WHEREAS, this matter came on regularly for hearing before
the Board of Supervisors of the County of Butte, State of
California, on July 26, 1994, in the Board Chambers,
Butte County Administration Building, Oroville, California; and,
WHEREAS, it appearing to said Board that notice of the
time and place of the hearing on the petition for the abandonment
of the right-of-way in question was duly and regularly given as
required by law; and,
WHEREAS, testimony and evidence, both oral and
documentary, having been produced at said hearing, from which said
Board now finds that the hereinafter described public right-of-way
is unnecessary for present or prospective public use.
NOW, THEREFORE, IT IS HEREBY ORDERED as follows:
1. That the public right-of-way situated in the County
of Butte, State of California, as hereinafter more particularly
described, is hereby abandoned pursuant to Chapter 3 of Part 3 of
Division 9 of the California Streets and Highways Code (commencing
with Section 8320).
2. That said public right-of-way so abandoned is located
in the unincorporated area of the County of Butte, State of
California, is identified as at the easterly end of Openshaw Road,
94-41918
northwest of the Highway 149, Highway 70 Intersection, central
Butte County AP 41-200-019, 038, 41-160-050, and is more
particularly described as follows:
See Attached Exhibit
3. That a map showing the right-of-way hereby abandoned is on
file in the Office of Butte County Department of Public Works, 7
County Center Drive, Oroville, California 95965.
4. That the Clerk of this Board shall cause a certified copy
of this Resolution, with the seal of the Board of Supervisors of
the County of Butte, State of California, to be recorded in the
office of the Recorder of the County of Butte, State of California.
PASSED AND ADOPTED by the Butte County Board of
Supervisors this 26th day of July , 1994, by the
following vote:

ABANDONMENT OF A PORTION OF
OPENSNAW ROAD

All that portion of Openshaw Road (formerly State Route 149) as described in deed to the
County of Butte dated August 25, 1868 and filed for record in Book "N", Deeds at Page 2,
said portion also being a portion of "SEGMENT NUMBER 1 " as described in that certain
"RELINCIUISHMENT OF HIGHWAY RIGHT-OF-WAY, REQUEST NO. 026303-X" as filed for
record in Book 2045, Official Records at Page 355 and also a portion of said "SEGMENT
NUMBER 1 " as described in deed from G. & M. Ranches to the State of California dated June
2, 1975 and filed for record in Book 2026, Official Records at Page 10, all lying in Sections
15 and 16, Township 20 North, Range 3 East, M.D.M. Butte Gounty, California, and being
more particularly described as the following two described parcels:
PARCEL ONE:
A strip of land, of varying width, lying both to the right and to the left of the following
described centerline, over a portion of Section 15 and 16, Township 20 North, Range 3 East,
M.D.M. ,said centerline being mare particularly described as follows:
Commencing at the northwest corner of that certain parcel of land as described in deed to the
Butte County Sheriff Mounted Posse, as filed for record in Official Records as Serial Number
92-02101, said corner being marked upon the ground by a one-half inch re-bar tagged L.S.
4085 as shown on that Record of Survey as filed for record in Book 124, Maps at Page 60;
thence N 00°29'56" W, along the northerly projection of the west line of said parcel, 45.51
feet, to a point on the centerline of Openshaw Road; thence S 62°00'17" E, along said
centerline, 175.OOfeet, to the TRUE POINT OF BEGINNING for the herein described centerline;
thence S 62°00'17" E, 254.42 feet, to the beginning of a curve to the right, having a radius
of 650,00 feet and a central angle of 27°55'00"; thence southeasterly along said curve,
316.70 feet; thence S 34°05'17" E, 961.52 feet, to a point on the east line of said Section
16; thence S 34°05'17" E, 218.4 feet, more or less, to a point on the southerly boundary
of said SEGMENT NUMBER 1 , and the end of the described centerline.
PARCEL TWO:
That certain parcel of land as described in deed from G. & M. Ranches to the State of
California dated June 2, 1975 and filed for record in Book 2026, Official Records at Page 10,
lying in Section 15, Township 20 North, Range 3 East, M.D.M. Butte County, California,
RESERVING from the two above described parcels, any existing easements and(or rights at
any time, or from time to time, to maintain, operate, replace, remove, renew and enlarge the
existing public utility facilities and facilities incidental thereto, including access to protect the
property from all hazards in, upon, over the highway herewith abandoned.
