RESOLUTION CALLING ELECTION FOR ADVISORY VOTE ON
ESTABLISHMENT OF A
COUNTY SERVICE AREA TO PROVIDE ANIMAL CONTROL SERVICES
WHEREAS, the Board of Supervisors of the County of Butte has
previously determined in 1990 and again in 1992 that it would be in
the public interest to establish a County Service Area to provide
animal control services; and
WHEREAS, said determinations were subject to confirmation by the
voters of the proposed areas; and
WHEREAS, at the elections held on June 5, 1990 and on June 9,
1992, the establishment of such County Service Areas was not confirmed
by the voters at said elections and the service areas were therefore
not established; and
WHEREAS, there is a continuing need for animal control services
within the County of Butte; and
WHEREAS, due to fiscal constraints the County of Butte is unable
to provide the needed animal control services with general revenues;
and
WHEREAS, it is not desirable to institute proceedings for the
establishment of a County Service Area again unless it can first be
determined whether or not such proceedings would be supported by the
electorate; and
WHEREAS, Elections Code Section 5353 provides a procedure whereby
an advisory election may be held for the purpose of allowing voters
to voice their opinion on substantive issues or to indicate to the
Board of Supervisors approval or disapproval of a ballot proposal.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the
County of Butte, State of California as follows:
1. A special election is hereby called to be held on November
8, 1994, within the unincorporated territory of the County of Butte.
2. The question to be submitted to the voters at said election
shall be:
"Advisory Vote Only
Should proceedings be instituted to establish a County
Service Area to provide animal control services and to levy
a service charge therefor, said service charge not to
exceed $5.00 annually per parcel of real property.
3. Said election shall be held and conducted by the County and
the ballots canvassed in accordance with the provisions of Article 1
(commencing with Section 3700) of Chapter 2, Division 4 of the
Elections Code. The County Clerk shall publish a notice of the
election pursuant to Elections Cade Sections 2544 and 2653.
4. Said election shall be consolidated with the general
election to be held in the same area an the same date. The hours of
the election, the precincts, polling places, and voting booths shall
be the same, and there shall be only one set of election officers in
each of the precincts.
5. The boundaries of the territory which would be included
within the County Service Area would include all that property located
within the unincorporated territory of the County of Butte.
6. The type of extended county services to be provided within
said County Service Area would be animal control services not provided
to the same extent on a county-wide basis both within and without
cities.
PASSED AND ADOPTED by the Butte County Board of Supervisors this
9th day of August , 1994, by the following vote:
