~~~"'~~ RESOLUTION ABANDONING A PUBLIC RIGHT-OF-WAY
(ORO FIND DRIVE}
WHEREAS, this matter came an regularly for hearing before
the Board of Supervisors of the County of Butte, State of
California, on August 23, 1994, in the Board Chambers, Butte County
Administration Building, Oroville, California; and,
WHEREAS, it appearing to said Board that notice of the
time and place of the hearing on the petition for the abandonment
of the right-of-way in question was duly and regularly given as
required by law; and,
WHEREAS, testimony and evidence, both oral and
documentary, having been produced at said hearing, from which said
Board now finds that the hereinafter described public right-of-way
is unnecessary for present or prospective public use.
NOW, THEREFORE, IT IS HEREBY ORDERED as follows:
1. That the public right-of-way situated in the County
of Butte, State of California, as hereinafter more particularly
described, is hereby abandoned pursuant to Chapter 3 of Part 3 of
Division 9 of the California Streets and Highways Code (commencing
with Section 8320}.
2. That said public right-of-way so abandoned is located
in the unincorporated area of the County of Butte, State of
California, is identified as Ora Fino Drive, and is more
particularly described as follows:
Being a portion of Parcels 1, 2, 3 and 4 as shown on that certain
map filed for record in Book 81 of Parcel Maps, at Page 54, more
particularly described as follows:
A 60 foot wide non-exclusive easement known as Oro Fino Drive far
ingress, egress and public utilities, lying 30 feet on each side of
the following described centerline;
Commencing at the Southwest corner of said Parcel 1;
Thence leaving said commencement point along the West line of said
Parcel 1 North 00 degree 52' 05" West, 335.00 feet to the TRUE
POINT OF BEGINNING for the following described centerline;

Thence leaving said Point of Beginning and said West line of Parcel
1 North 89 degrees 02' 02" East, 1328.48 feet to the East line of
said Parcel 4 and the terminus of said centerline.
EXCEPTING THEREFROM that portion of Whitchurch Lane that crosses
said Oro Fino Drive as shown in Book 111 of Parcel Maps, at Page 52
and Book 111 of Parcel Maps, at Page 55.
The following Reservation may be included in the Final Resolution:
EXCEPTING AND RESERVING any existing easements and/or right at any
time, or from time to time, to maintain, operate, replace, remove,
renew and enlarge the existing public utility facilities and
facilities incidental thereto, including access to protect the
property from all hazards in, upon, and aver the highway herewith
to be abandoned.
3, That a map showing the non-exclusive easement for ingress,
egress and public utilities, to be abandoned is an file in the
Office of Butte County Department of Public Works, 7 County Center
Drive, Oroville, California 95965.
4. That the Clerk of this Board shall cause a certified copy
of this Resolution, caith the seal of the Board of Supervisors of
the County of Butte, State of California, to be recorded in the
office of the Recorder of the County of Butte, State of California.
PASSED AND ADOPTED by the Butte County Board of
Supervisors this 23rd day of August , 1994, by the
following vote:
AYES: Supervisors Meyer, Dolan, Houx, Thomas and Chair McLaughlin
