RESOLUTION APPROVING THE EXPANSION OF POWERS FOR CSA NO. 151 (SHASTAN, INC.) TO INCLUDE MAINTENANCE AND OPERATION OF SANITARY SEWER FACILITIES WHEREAS, on June 8, 1993, the Board of Supervisors of the County of Butte, State of California, adopted and passed Resolution No. 93-74 establishing County Service Area No. 151; and WHEREAS, on August 4, 1994, the Butte Local Agency Formation Commission (LAFCo) adopted and passed Resolution No. 94-01 making determinations and approving the Expansion of Powers of CSA #151 to include maintenance and operation of sanitary sewer facilities for the Guynn's Corner Subdivision; and WHEREAS, a Negative Declaration with mitigations was adopted by the Butte County Development Review Committee on October 5, 1992, pertaining to the Guynn's Corner Subdivision; and WHEREAS, LAFCo has certified that it has reviewed and considered the Negative Declaration with mitigations and that there are no sufficient grounds to require supplementing it; and WHEREAS, the application for the Expansion of Powers of CSA #151 has 100% signature of the property owners, and this Board is therefore authorized to proceed without holding a public hearing. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Butte, State of California, as follows: 1. Said Board certifies that it has reviewed and considered the Negative Declaration with mitigations adopted by the Development Review Committee on October 5, 1992, and there are no sufficient grounds to require supplementing it. 2. Said Board hereby finds and determines that the proceedings herein were conducted pursuant to Section 25210.1 et seq. of the Government Code; 3. Said Board hereby determines to approve the Expansion of Powers for said CSA #151 as specified below. A. Maintenance and operation of the sanitary sewer facilities shall be performed by the City of Chico or under contract by a qualified service provider approved by the City of Chico. B. The CSA shall provide adequate resources for compliance with all monitoring and other Regional Water Quality Control Board Waste Discharge Requirements. C. The CSA shall provide adequate resources andtor mechanism to insure adequate funding of a major sewage treatment and a disposal facility replacement or reconstruction if necessary. 4. The short form designation of these proceedings is: 95-01 -GSA #151 (Shastan, Inc.) - Expansion of Powers. 5. The following type of service is found to be an additional extended service: maintenance and operation of sanitary sewer facilities. 6. In accordance with the provisions of Government Code Section 25210.77a and Butte County Code Sections 21-85 through 21-9Q, and following a public hearing thereon, aper-parcel service charge shall be levied against all the parcels within County Service Area No. 151. Each parcel shall be assessed an individual service charge based upon benefit. Said charge shall appear as a separate item on the tax bill and shall be collected at the same time and in the same manner as ordinary county ad valorem property taxes are collected and shall be subject to the same penalties and the same procedure and sale in case of delinquency as provided for such taxes. All laws applicable to the levy, collection and enforcement of county ad valorem taxes shall be applicable to such charge; except that if for the first year such charge is levied, the real property to which such charge relates has been transferred or conveyed to a bona fide purchaser for value, or if a lien of a bona fide encumbrancer for value has been created and attaches thereon, prior to the date on which the first installment of said taxes would become delinquent, the charge confirmed shall not result in a lien against such real property but instead shall be transferred to the unsecured roll for collection.
