HomeMy WebLinkAbout94-121WHEREAS, a public agency, the Butte County Board of Supervisors has petitioned the Butte County Planning Commission and Board of Supervisors, through an appropriate application; to amend the Butte County General Plan Land Use Element, for a change from Law Density Residential to Industrial far that property identified on Exhibit A-1, attached hereto; and WHEREAS, the proposed General Plan Amendment has been studied and reviewed by the Butte Gounty Planning Commission and a public hearing held pursuant to law, at which time all interested persons were heard; and WHEREAS, the Butte County Board of Supervisors has reviewed and considered the contents of the environmental review study checklist (Exhibit A-2) prepared on the amendment pursuant to the California Environmental Quality Act; and WHEREAS, the Butte County Board of Supervisors has held hearings on the General Plan Amendments at which all interested parties were heard; and WHEREAS, the Butte County Board of Supervisors finds the proposed amendment complies with all elements of the Butte County General Plan and comprises an overall internally consistent whole, specifically: RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE APPROVING THE ADOPTION OF A GENERAL PLAN AMENDMENT TO THE BUTTE COUNTY LAND USE ELEMENT. ~. The amendment complies with the policies of the Butte County General Plan. 2. The amendments provide for compatible development with existing land uses. NOW, THEREFORE, BE IT RESOLVED as follows: 1. The General Plan Amendment to Industrial as shown on the attached Exhibit A-1 are hereby incorporated by reference. 2. The General Plan Amendment is hereby adopted and by the Board of Supervisors of the County of Butte as amendments to the Butte County General Plan Land Use Element, said Amendments to be the land use policy for the County of Butte in the affected area for all findings pursuant to law. BE IT FURTHER RESOLVED, that pursuant to Government Code Section 65359 that the General Plan be endorsed to show that the above amendments have been approved by this Board. Project Description and Location: A General Plan Amendment to change the Land Use designation from Low Density Residential to Industrial and a Rezone from A-R to M-1. A .84 acre parcel located at the northeast side of Humbolt Avenue and Bartlett Street. The requested change will recognize an existing non-corlfonning use and allow expansions without additional use permits. On April 12, 1994, the Board directed staff to initiate these amendments along Humbolt Ave. to encourage local businesses to expand. The requests represent the first phase in solving a myriad of conflicts with existing uses in the Chapmantawn area. Additional project description and area description can be found in the data sheet at the end of this document. II. EVALUATION OF ENVIRONMENTAL IMPACTS 1. Earth. Will the proposal result in: a. Unstable earth conditions or changes in geologic substructures? Yes No X Maybe Response: One lot contains an existing manufacturing struc#ure. The proposed expansion area corrrains a residential building. The property is level and will not require any significant grading. The proposal will not affect subsurface earth conditions. The use consists of the assembly and sales of mattresses. No nuisance issues have been noted with the operation.
