COUNTY OF BUTTE PURSUANT TO THE REQUIREMENTS OF THE CALIFORNIA INTEGRATED
WASTE MANAGEMENT ACT OF 1989

WHEREAS, the County of Butte recognizes that it is in the public interest to enact and implement an
Integrated Waste Management Plan to address the State's diminishing Iandfzll capacity and the potential adverse
environmental impacts from landfilling; and
WHEREAS, the Califozxzia Integrated Waste Management Act of 1989 (Division 30 of the Public
Resources Code, commencing with Section 40000) requires in Public Resources Code Section 41300 et seq., that
the County adopt a Source Reduction and Recycling Element, to be iuucluded within the County Integrated Waste
Management PIan; and
WHEREAS, the California Integrated Waste Management Act of 1989 requires in Public Resources Code
Section 41500, et seq., that the County adopt a Household Hazardous Waste Element, to be included within the
County Integrated Waste Management Plan; and
WHEREAS, as part of its plan to conserve landfill capacity and address potential environmental impacts
from landfzlling, the Board of Supervisors of the County of Butte adopted the Source Reduction and Recycling
Element and Household Hazardous Waste Element on November l0, 1992; and
WHEREAS, the California Integrated Waste Management Act of 19$9requ:ures in Public Resources Code
Section 41731, et seq., that the County adopt aNon-Disposal (Recycling) Facility Element which identifies all new
non-disposal facilities and any expansions of existing non-disposal facilities that will be needed to assist the
County to implement its Source Reduction and Recycling Element; and
WHEREAS, a "non-disposal facility" is defined in Public Resources Code Section 40151 as any solid
waste facility required to obtain a state solid waste facilities permit from the California Integrated Waste
Management Board except a disposal facility or a transformation facility; and
WHEREAS, aNon-Disposal Facility Element was prepared for the County, dated October 1994,
addressing the existing and future non-disposal facilities required for the County; and
WHEREAS, no environmental review of the Non-Disposal Facility Element is required by law; and
WHEREAS, the Non-Disposal Facility Elenfent for the County was submitted to the Butte County
Integrated Waste Management Local Task Force for review and comment; and
WHEREAS, at its September Z1, 1994 meeting the Butte County integrated Waste Management Local
Task Force, pursuant to the requirements of the California Integrated Waste Management Act of 19$9, has
reviewed the proposed final draft Non-Disposal Facility Element for the County of Butte, and found that said
document is consistent with the legislative intent and requ:urements of the California Integrated Waste
Management Act of 19$9, and has formally recommended that the Board of Supervisors of the County of Butte
adopt the final draft Non-Disgasal Facility Element; and
WHEREAS, a public hearing before the Board of Supervisors of the County of Butte, State of California,
for purposes of receiving public input and considering adoption of the final draft Non-Disposal Facility Element
for the County of Butte has received appropriate legal public notice and has been conducted by the Board of
Supervisors during its meeting of Navember 22 1994; and
WHEREAS, it is in the best interests of the general public of Butte County that the proposed final draft
Non-Disposal Facility Element for the County of Butte be formally adopted.
NOW, THEREFORE, the Butte County Board of Supervisors of the County of Butte does hereby
resolve that the final draft Non-Disposal Facility Element for the County of Butte as set forth in Exhibit "A,"
attached hereto and made a part thereof, is hereby adopted.
PASSED AND ADOPTED by the Board of Supervisors, County of Butte, State of California, this
22nd day of November 1994 by the following vote:
AYES: Supervisors Meyer, DoJ.an, Houx, Thomas and Chair McLaughlin
