A RESOLUTION OF CONSENT FOR WETLAND HABITAT EASEMENT ACQUISITION
BY THE U.S. FISH AND WILDLIFE SERVICE IN AN
UNINCORPORATED AREA OF BUTTE COUNTY
WHEREAS, the Board of Supervisors of Butte County has studied the
proposal of the U.S. Fish and Wildlife Service of the Department of
Interior to acquire, on a willing seller basis, a wetland habitat
easement, from Gerald DeBret and Tom Gigliotti, the officers of a
General Partnership known as Lucky Ten Ranch, and that said Partnership
is the owner of property located in that area of Butte County, more
particularly delineated on the map attached hereto and marked Exhibit A;
and
WHEREAS, the U.S. Fish and Wildlife Services, proposes to acquire
this land within Butte County in accordance with the North American
Waterfowl Management Plan and the Central Valley Habitat Joint Venture
Implementation Plan, a copy of which documents are attached hereto and
marked Exhibit B and Exhibit C; and
WHEREAS, the U.S. Fish and Wildlife Service proposes to use
Migratory Bird Conservation Funds to acquire a perpetual conservation
easement on the property, and this funding source requires County
concurrence prior to the purchase; and
WHEREAS, the U.S. Fish and Wildlife Service has completed an
Environmental Assessment under the National Environmental Policy Act for
the North Central Valley Wildlife Management Area, and has authorized,
the program, a copy of said document is attached hereto and marked`
Exhibit D.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors
stipulates that the following conditions must be met. prior to any
acquisition:
1. That the acquisition of this conservation easement is
restricted to the property described in Exhibit A which is
hereby authorized by the Board of Supervisors for acquisition.

2. That Lucky Ten Ranch shall retain mosquito abatement
responsibility over the property described in Exhibit A.
BE ZT FURTHER RESOLVED by the Board of Supervisors of Butte County
that pursuant to law:
(1} This approval is categorically exempt from the provisions of
the California Environmental Quality Act; and
(2} The Board of Supervisors does hereby consent to the
acquisition of this wetland easement as set forth in the North
Central Valley Wildlife Management Area Environmental
Assessment and as described in Exhibit A.
