(OAK WAY SUBDIVISION}
WHEREAS, on January 7, 1988, the Board of Supervisors of the County of
Butte, State of California, adopted and passed Resolution No. 88-017 establishing
County Service Area No. 105 (Oak Way Subdivision); and
WHEREAS, on November 3, 1994, the Butte Local Agency Formation
Commission ("LAFCo") adopted and passed Resolution No. 94-06 making
determinations and approving the annexation to County Service Area No. 105 to
include the provision of street lighting and storm drain maintenance; and
WHEREAS, a Negative Declaration with mitigation measures was filed by the
Department of Development Services, Planning Division, on August 10, 1990; and
WHEREAS, LAFCo has certified that it has reviewed and considered the
Negative Declaration with mitigation measures and that there are no sufficient grounds
to require supplementing it; and
WHEREAS, the application for the annexation to County Service Area No. 105
has 100% signature of the property owners, and this Board is therefore authorized to
proceed without holding a public hearing.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the
County of Butte, State of California, as follows:
1. Said Board hereby finds and determines that the proceedings herein were
conducted pursuant to Section 25210.1 et seq. of the Government Coda.
2. Said Board hereby determines to approve the annexation to County Service
Area No. 105 (Oak Way Subdivision) as specified below.
a. Said Board certifies that it has independently reviewed and considered the
Negative Declaration with mitigation measures prepared by the Department of
Development Services, Planning Division, and filed on August 10, 1990, and
there are no suf'f'icient grounds to require supplementing it.
3. The short form designation of these proceedings is: 95-04 -Annexation to
CSA #105 (Oak Way Subdivision).
4. The following types of services are found to be an additional extended
service and is to be provided within the said area: provision of street lighting and
storm drain maintenance.
5. In accordance with the provisions of Government Code Section 25210.77a
and Butte County Code Sections 21.85 through 21.90, and following a public hearing
thereon, aper-parcel service charge shall be levied against all the parcels within
County Service Area No. 105. Each parcel shall be assessed an individual service
charge based upon benefit. Said charge shall appear as a separate item on the tax
bill and shall be collected at the same time and in the same manner as ordinary
county ad valorem property taxes are collected and shall be subject to the same
penalties and the same procedure and sale in case of delinquency as provided for
such taxes. All laws applicable to the levy, collection and enforcement of county ad
valorem taxes shall be applicable to such charge; except that if for the first year such
charge is levied, the real property to which such charge relates has been transferred
or conveyed to a bona fide purchaser for value, or if a lien of a bona fide
encumbrancer for value has been created and attaches thereon, prior to the date on
which the first installment of said taxes would become delinquent, the charge
confirmed shall not result in a lien against such real property but instead shall be
transferred to the unsecured roll for collection.

ANNEXATION TO
COUNTY SERVICE AREA # 105
All that certain real property situate in the State of Califor-
nia, County of Butte, described as follows:
Parcel 4, as shown on that certain Parcel Map, recorded in the
office of the Recorder of the County of Butte, State of Califor-
nia, on March 19, 1980, in Book 76 of Maps, at page 26, more par-
ticularly described as follows:
COMMENCING at the intersections of Glenwood Drive and Oak Way;
Thence East a distance of 314.99 feet;
Thence South a distance of 30.00 feet to the northwest. corner of
said Lot 4 and the True Point of Beginning for this description;
Thence South 00°01'10" East a distance of 465.62 feet;
Thence North $9°57.48" East a distance of 182.62 feet;
Thence North 00°02'36" West a distance of 465.50 feet;
Thence West a distance of 182.43 feet to the point of beginning;
and containing 1..95 acres more or less.
