TO PORTION OF DURHAM BICYCLE PATH EASEMENT
(HENNEMAN FARMS, INC.)
WHEREAS, the County of Butte has constructed a bicycle
path from Jones Avenue to Hegan Lane between Durham and Chico; and
WHEREAS, the County has obtained insured title to all of
the easement upon which the said path has been constructed, with
the exception of one remaining parcel adjoining the property of
Henneman Farms, Inc.; and
WHEREAS, as to said remaining parcel the County of Butte
has obtained a deed from Center Land Company, the successor in
interest of the railroad which owned the railroad right of way; and
WHEREAS, as to said remaining parcel, the County of
Butte has also filed a condemnation action {Butte County Superior
Court case number 116909} and served all parties having potential
interests in said parcel;
WHEREAS, all parties served in said condemnation action,
with the exception of Henneman Farms, Inc., have filed papers with
the Court disclaiming any interest in the said parcel; and
WHEREAS, the County of Butte has reached a settlement
agreement with Henneman Farms, Inc., and has obtained and accepted
a deed from said corporation granting an easement for the bicycle

path to the County, thus resolving all remaining issues in the
pending condemnation action (Butte County Superior Court case
number 116909}.
NOW, THEREFORE, BE IT RESOLVED by the Board of
Supervisors: that the County will guarantee the title to the
bicycle path easement adjoining the property of Henneman Farms,
Inc., and is willing to take appropriate steps to assure adequate
title thereto, including, if necessary, further eminent domain
proceedings.
