HomeMy WebLinkAbout95-035WHEREAS, the Butte County Board of Supervisors had earlier adopted resolutions limiting public access hours of the Butte County Superior Court and the Butte County Municipal Courts {Resolution Nos. 93-17fl, 93-173 and 93--176} to reflect the Board's general policy of limiting the County work week to four days as set forth in Ordinance No. 31.03; WHEREAS, the Butte County Superior and Municipal Courts have presented compelling evidence to this Board that the reduced work week has resulted in a growing backlog of work and cases, especially civil matters; WHEREAS, the Butte County Superior and Municipal Courts have presented compelling evidence that the reduced work week has adversely affected the ability of these Courts to comply with the mandated disposition timelines; WHEREAS, the Butte County Superior and Municipal Courts have presented compelling evidence to this Board demonstrating that the reduced work week may adversely affect the pending task of Court consolidation; and, WHEREAS, the Butte County Superior and Municipal Courts have obtained funding assurances from the State Trial Court budget Commission sufficient to offset the increase in salaries and benefits necessary by a restoration of a 40 hour per week court schedule; and, WHEREAS, the State Trial Court Budget Commission has indicated that Page 1 RESOLUTION RETURNING THE BUTTE COUNTY SUPERIOR AND MUNICIPAL COURT OPERATIONS TO A 40 HOUR WORK WEEK such or similar augmentation be made permanent in an effort to establish a state-wide uniform court operation week of 40 hours. NOW, THEREFORE, BE IT RESOLVED, that: 1. the above-mentioned resolutions reducing the work weeks of the Butte County Superior and Municipal Courts are hereby rescinded and the Butte County Superior and Municipal Courts are no longer subject to the reduced work-week established by Butte County Code Section 2-1; 2. the Butte County Superior and Municipal Courts be restored to a 40 hour per week schedule; 3. the return of the Butte County Superior and Municipal Courts to a 40 hour week schedule be done in such a manner as to eliminate or reduce any impact upon any other County department, to the extent possible; 4. the continued restoration of a 40 hour court schedule is dependent upon and subject to adequate funding of the same; should the state of California substantially alter its trial court funding position, the Board expressly reserves its discretion to reimpose the reduced work week.
