LOCAL AGENCY FORMATION COMMISSION
REGARDING PROPOSAL FOR ESTABLISHMENT OF A
COUNTY SERVICE AREA FOR ANIMAL CONTROL SERVICES
WHEREAS, on November S, 1994, an advisory election was held for the purpose of
determining voter support for establishment of a County Service Area to provide animal control
services in the unincorporated territory of the County of Butte, and to levy a charge therefor;
WHEREAS, establishment of such County Service Area was supported by a majority
of the voters at said election;
WHEREAS, the Board of Supervisors of the County of Butte desires to institute
proceedings for the establishment of a County Service Area to provide animal control services which
are not provided to the same extent on a countywide basis both within and without cities;
WHEREAS, no proceedings for the establishment of such service area shall be
instituted by this Board or requested by its members until approval of the Local Agency Formation
Commission is first obtained.
NOW, THEREFORE, BE 1T' RESOLVED and ordered by the Board of Supervisors
of the County of Butte as follows:
1. An application and proposal is hereby made to the Local Agency Formation
Commission in accordance with the Kortese Knox Reorganization Act of 1985 beginning with
Government Cade Section 56000, for establishment of a County Service Area.
2. Establishment of said Service Area is proposed under County Service Area Law
(Chapter 2,2, Part 2, Division 2, Title 3 ofthe Government Code commencing with Section 25210.1).
3. Establishment of said County Service Area is subject to the following terms and
conditions:
A. The type of extended county services to be provided shall be animal control
services which are not provided to the same extent an a countywide basis both within and without
cities.
B. An annual parcel charge shall be levied to support such animal control services
in an amount not to exceed five dollars ($5.00) per parcel of real property located in the
unincorporated territory of the County of Butte. Persons or entities having an ownership interest in
more than five parcels of real property may apply for a fee exemption on those parcels above five
which are under a single ownership.
3. Boundaries of the proposed County Service Area shall be all that property located
within the unincorporated territory of the County of Butte.
4. The Board of Supervisors hereby finds that formation of the County Service Area will
have no significant effect on the environment and is therefore covered under the General Rule
Exemption per Section 15061(b)(3) of the State Guidelines for (implementation of the California
Environmental Quality Act.
5. The Clerk of the Board is authorized and directed to file a certified copy of thss
resolution with the Executive Officer of the Butte County Local Agency Formation Commission.

of California this 9~h day of May , 1995, by the following vote:
